Abstract

Globalisasi memberikan kemudahan pada masyarakat untuk bersosialisasi, di mana mereka dapat bertemu dengan orang baru dan juga memperoleh informasi mengenai negara asing. Pada saat ini, merupakan hal yang biasa apabila seseorang mengubah kewarganegaraannya. Suami yang mengubah kewarganegaraannya menjadi Warga Negara Indonesia setelah perkawinannya harus mengikuti hukum Indonesia. Kedudukan hukum dan hak waris istri dan anak harus mengikuti ketentuan berdasarkan peraturan perundang-undangan Indonesia. Penelitian ini akan membahas dampak naturalisasi warga negara asing terhadap perkawinan dan pewarisan di Indonesia. Dalam melakukan penelitian, metode penelitian yang Penulis gunakan adalah normatif empiris dan jenis data yang digunakan dalam penelitian ini adalah data sekunder dan data primer. Cara perolehan data yang digunakan dalam penelitian ini adalah studi kepustakaan dan wawancara, Jenis pendekatan dalam penelitian ini adalah pendekatan sistematika hukum. Tesis ini menggunakan analisis data kualitatif. Hasil dari penelitian yang penulis lakukan, perkawinan antara dua Warga Negara Asing dan jika salah satu pihaknya menjadi Warga Negara Indonesia harus didaftarkan. Jika perkawinan telah didaftarkan, maka perkawinan tersebut adalah sah di hadapan hukum Indonesia. Istri dan anak dari perkawinan itu akan menjadi ahli waris berdasarkan undang-undang dan mendapatkan bagian warisannya tanpa mengesampingkan ketentuan mengenai hukum pertanahan di Indonesia. / Globalization makes it easier for people to socialize, where they can meet new people and discover other country. In this era, it’s common for people to change their citizenship. Husband that changes their citizenship to Indonesian citizen after his marriage need to follow the country law. The legal position and the inheritance right of their wife and children will be according to Indonesian law. This research will discuss the impact naturalization foreign citizen on marriage and inheritance in Indonesia. In conducting research, the type of research that author used is empirical normative research and the type of data in this research used is secondary data and primary data. Data acquisition method that used in this research is from literature study and interviews. Type of approach that used in this research is systematic system of law. This thesis used qualitative data analysis techniques. From the results of research that the author did, the marriage between two foreign citizen and if one of them become an Indonesian citizen, need to be registered. If the marriage is registered, the marriage is legal in front of Indonesian law. Wife and children from that marriage will be the rightful heir by law and get their share of the inheritance without ruling out provisions regarding of Indonesian land law.
