Abstract

Perlindungan hukum bagi Notaris terkait Akta Notaris yang dibuat atas dasar keterangan palsu oleh penghadap ialah diatur pada Pasal 66 UUJN yang menempatkan Majelis Kehormatan Notaris memiliki kewenangan untuk menyetuji atau tidak menyetujui pemanggilan notaris untuk hadir dalam pemeriksaan perkara. Notaris berfungsi untuk mengakomodir yang dikehendaki dan dikemukakan oleh para pihak yang menghadap kepada Notaris tersebut untuk dituangkan ke dalam akta otentik. Notaris hanya terbatas pada pembuktian secara formil dan tidak diwajibkan untuk menyelidiki secara materiil terhadap pernyataan para penghadap, Artinya akta yang dibuat di hadapan Notaris apabila dikemudian hari bermasalah, maka urusan tersebut sepenuhnya akan menjadi tanggung jawab para pihak, Notaris tidak dapat dilibatkan karena Notaris bukan para pihak dalam akta tersebut, kecuali Notaris melakukan kesalahan pada proses pembuatannya. Apabila kasus ini dikaitkan dalam dalam tesis ini, bahwa penghadap Gunawan Priambodo yang memberikan Akta Kuasa Menjual dan ternyata belakangan terungkap Akta Kuasa Menjual tersebut sudah dicabut oleh pemberi kuasa sebagaimana disebutkan di atas, dalam hal ini Notaris harus tunduk pada hukum perjanjian mengenai syarat sahnya perjanjian yang diatur dalam Pasal 1320 KUHPer. Dengan demikian dapat ditentukan bahwa keterangan atau bukti palsu yang diberikan oleh pihak kepada notaris merupakan perbuatan jahat, yang melanggar perjanjian objektif, yaitu mempunyai alasan yang sah. Keadaan-keadaan tersebut dapat mengakibatkan perbuatan notaris tersebut batal demi hukum. / Legal protection for a Notary regarding a Notary Deed made on the basis of false information by the appearer is regulated in Article 66 UUJN which places the Notary Honorary Council having the authority to approve or disapprove the summons of a notary to attend a case examination. The function of the notary is to accommodate what is desired and put forward by the parties who appear before the notary to be included in an authentic deed. The notary is only limited to formal proof and is not required to materially investigate the statements of the appearers. This means that if the deed made before a notary has problems in the future, then this matter will be fully the responsibility of the parties, the notary cannot be involved because the notary is not the party to the deed, unless the Notary made a mistake in the process of making it. If this case is linked in this thesis, that the appearer Gunawan Priambodo was the one who gave the Deed of Authorization to Sell and it was later revealed that the Deed of Authorization to Sell had been revoked by the attorney as mentioned above, in this case the Notary must comply with the legal agreement regarding the legal terms of the agreement regulated in Article 1320 of the Civil Code. Thus it can be determined that false information or evidence provided by the party to the notary is an evil act, which violates the objective agreement, namely having a valid reason. These circumstances can result in the notary's actions being null and void by law.
