Abstract

Rumah ibadah memiliki peran penting dalam kehidupan keagamaan, karena selain sebagai tempat ibadah, juga menjadi pusat kegiatan keagamaan. Pentingnya rumah ibadah dalam kehidupan keagamaan mengakibatkan sering kali masyarakat menganggapnya sebagai pusat kegiatan keagamaan dan sosial, sehingga menjadi bagian penting dalam membangun kehidupan beragama yang harmonis. Persoalan yang sering kali terjadi, menyangkut hubungan antar umat beragama di Indonesia, adalah terkait pendirian rumah ibadah, seperti kasus yang terjadi di Cilegon dimana pembangunan Gereja HKBP Maranatha Cilegon mendapatkan penolakan dari sekelompok masyarakat. Artikel ini menemukan bahwa hak milik dapat diberikan kepada badan hukum yang ditetapkan oleh Pemerintah sesuai dengan ketentuan peraturan perundang-undangan, salah satunya badan keagamaan dan terkait perlindungan hukum dalam hal terjadinya sengketa atau perselisihan akibat pendirian rumah ibadat secara garis terdapat 3 (tiga) forum untuk penyelesaian perselisihan akibat pendirian rumah ibadat yakni: musyawarah dengan masyarakat setempat, difasilitasi oleh Bupati/Walikota, dan litigasi atau pengadilan setempat. / Houses of worship have an important role in religious life, because apart from being a place of worship, it is also a center of religious activities. The importance of houses of worship in religious life has resulted in people often considering them as centers of religious and social activities, so that they become an important part of building a harmonious religious life. Problems that often occur, regarding inter-religious relations in Indonesia, are related to the establishment of houses of worship, such as the case in Cilegon where the construction of HKBP Maranatha Church Cilegon received rejection from a group of communities. This article finds that property rights can be granted to legal entities established by the Government in accordance with the provisions of laws and regulations, one of which is religious bodies and related to legal protection in the event of disputes or disputes due to the establishment of houses of worship in line there are 3 (three) forums for dispute resolution due to the establishment of houses of worship, namely: consultation with the local community, facilitated by the Regent/Mayor, and local litigation or courts.
