Abstract

Disahkannya Peraturan Pemerintah Nomor 24 Tahun 2022 Tentang Peraturan Pelaksanaan Undang-Undang Nomor 24 Tahun 2019 Tentang Ekonomi Kreatif merupakan salah satu upaya pemerintah untuk mendukung ekonomi kreatif. Dalam rangka mendukung berkembangnya ekonomi kreatif tersebut maka berdasarkan PP Nomor 24 Tahun 2022 para penggiat ekonomi kreatif dapat menjaminkan kekayaan intelektualnya sebagai jaminan hutang. Penelitian ini akan mengkaji peran notaris dalam memfasilitasi kekayaan intelektual sebagai jaminan fidusia. Penelitian ini bertujuan menganalisis dan memahami serta memberikan informasi kepada pembaca mengenai pengaturan mengenai kedudukan kekayaan intelektual yang dijadikan jaminan objek fidusia sesuai dengan peraturan pemerintah nomor 24 tahun 2022 tentang peraturan pelaksanaan undang-undang nomor 24 tahun 2019 dan Untuk menganalisis dan memahami peran notaris dalam kekayaan intelektual yang dijadikan jaminan utang pasca peraturan nomor 24 tahun 2022 tentang peraturan pelaksanaan undang-undang nomor 24 tahun 2019. Penelitian ini menggunakan metode analisis data kualitatif yang didasarkan pada pendekatan undang-undang yang mengacu pada PP Nomor 24 Tahun 2022 dan peraturan terkait di Indonesia. Penelitian ini menyimpulkan bahwa kekayaan intelektual tersebut melekat hak yang dinamakan hak kebendaan, namun saat ini tidak ada aturan pelaksanaan dari PP tersebut yang mengatur terkait pedoman hak kekayaan intelektual yang dapat dijadikan sebagai jaminan fidusia. Peran Notaris dalam perjanjian akta notariil yaitu seorang pejabat publik yang membingkai kesepakatan kedua belah pihak atau lebih untuk dijadikan suatu akta perjanjian yang notariil dan tidak dibawah tangan. Isi dari akta perjanjian tersebut merupakan kehendak atau keinginan para pihak yang menghadap kepada Notaris, bukan kehendak dari Notaris, sehingga peran notaris tertuang sesuai dalam UUJN, namun Perjanjian kredit dengan jaminan HKI merupakan hal baru dan belum ada pengaturan secara detail. / The ratification of Government Regulation Number 24 of 2022 concerning Regulations for Implementing Law Number 24 of 2019 concerning the Creative Economy is one of the government's efforts to support the creative economy. In order to support the development of the creative economy, based on Government Regulation Number 24 of 2022 creative economy activists can guarantee their intellectual property as collateral for debt. This research will examine the role of notaries in facilitating intellectual property as fiduciary guarantees. This study aims to analyze and understand and provide information to readers regarding arrangements regarding the position of intellectual property which is used as collateral for fiduciary objects in accordance with government regulation number 24 of 2022 concerning implementing regulations of law number 24 of 2019 and To analyze and understand the role of notaries in intellectual property which is used as collateral for debt after regulation number 24 of 2022 concerning implementing regulations of law number 24 of 2019. This study uses a qualitative data analysis method which is based on a statutory approach referring to PP Number 24 of 2022 and related regulations in Indonesia. This study concludes that intellectual property is attached to a right called material rights, but currently there are no implementing regulations from the PP governing guidelines for intellectual property rights that can be used as fiduciary guarantees. The role of a notary in a notarial deed agreement is a public official who frames the agreement of two or more parties to make a notarized deed of agreement and not private. The contents of the deed of agreement are the wishes or desires of the parties who appear before the Notary, not the will of the Notary, so that the role of the notary is stated in UUJN, but the credit agreement with IPR guarantee is new and there is no detailed regulation.
