Abstract

Implikasi dari pembuatan akta otentik yang ditanda tangani tanpa dihadiri pihak penghadap yang sebenarnya, mengakibatkan pihak-pihak yang menandatangani akta otentik tersebut harus bertanggung jawab secara pribadi, dikarenakan akta tersebut dianggap tidak pernah ada atau non existent. Selain hal tersebut notaris dapat juga dimintakan pertanggungjawaban dalam bentuk pengenaan sanksi yang berupa teguran lisan, teguran tertulis, pemberhentian sementara, pemberhentian dengan hormat atau pemberhentian dengan tidak hormat berdasarkan ketentuan dalam Pasal 85 UUJN. / The implication of making an authentic deed that is signed without the actual presence of the appearing party, results in the parties signing the authentic deed having to be personally responsible, because the deed is deemed to have never existed or non-existent. In addition to this, the notary can also be held accountable in the form of imposing sanctions in the form of verbal warnings, written warnings, temporary dismissals, honorable discharges or dishonorable discharges based on the provisions in Article 85 UUJN.
