Abstract

Merek sebagai Hak Kekayaan Intelektual merupakan tanda untuk mengidentifikasi asal usul barang dan jasa suatu perusahaan dengan barang dan/atau jasa perusahaan lain. Melalui merek tersebut, pengusaha dapat menjamin kualitas dan menjaga barang dan/atau jasa yang dihasilkan serta mencegah tindakan persaingan tidak jujur dari pengusaha lain. Penelitian ini menggunakan deskriptif analitis dengan pendekatan metode yuridis normatif dengan menggunakan bahan hukum primer dan sekunder yang dianalisis kemudian dikaitkan dengan peraturan perundang-undangan yang berlaku yaitu Undang-Undang Republik Indonesia Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan Undang-Undang Nomor 5 Tahun 1986 Tentang Peradilan Tata Usaha Negara. Hasil penelitian ini menunjukan bahwa Kepastian hukum atas hak merek terdaftar yang dihapus berdasarkan putusan yang telah berkekuatan hukum tetap yaitu pihak pemilik merek PT Ayam Geprek Benny Sudjono tetap mendapatkan hak merek nya sebagaimana yang telah didaftarkan dan mendapat perlindungan hukum seperti yang telah dijelaskan dalam putusan Nomor 196/G/2020/PTUN-JKT yang menyatakan batal Surat Keputusan atas nama Menteri Hukum Dan Hak Asasi Manusia Republik Indonesia, Direktur Jenderal Kekayaan Intelektual Nomor : HKI-KI.06.07-11 tanggal 6 Oktober 2020 dalam hal Penghapusan Merek Terdaftar Atas Prakarsa Menteri dan mewajibkan kepada Tergugat untuk mencabut Surat Keputusan atas nama Menteri Hukum Dan Hak Asasi Manusia Republik Indonesia, Direktur Jenderal Kekayaan Intelektual Nomor : HKI-KI.06.07-11 tanggal 6 Oktober 2020 dalam hal penghapusan merek atas Prakarsa Menteri. Pelaksanaan perlindungan hukum terhadap pemilik sertifikat hak merek yang sah berdasarkan putusan pengadilan yang sudah berkekuatan hukum tetap karena adanya gugatan pihak ketiga dimana pemegang Merek tersebut sudah memberikan Lisensi kepada pihak lain, dan perlindungan hukumnya terhadap pemegang Lisensi diatur dalam Pasal 48 Undang- Undang Merek. / Mark as an Intellectual Property Right is a sign to identify the origin of the goods and services of one company with the goods and/or services of another company. Through these marks, entrepreneurs can guarantee quality and maintain the goods and/or services produced and prevent acts of unfair competition from other entrepreneurs. This study uses analytical descriptive with a normative juridical method approach using primary and secondary legal materials which are analyzed and then linked to the applicable laws and regulations, namely the Law of the Republic of Indonesia Number 20 of 2016 concerning Marks and Geographical Indications and Law Number 5 of 2016 1986 concerning the State Administrative Court. The results of this study resulted in conclusions, legal certainty over registered trademark rights which were deleted based on decisions that have permanent legal force, namely the owner of the PT Ayam Geprek Benny Sudjono brand still gets the trademark rights as they have been registered and receive legal protection as explained in decision Number 196/G/2020/PTUN-JKT declaring null and void the Decree on behalf of the Minister of Law and Human Rights of the Republic of Indonesia, Director General of Intellectual Property Number: HKI-KI.06.07-11 dated October 6, 2020 in the case of Deletion of Registered Marks At the Initiative of the Minister and obliging the Defendant to revoke the Decree on behalf of the Minister of Law and Human Rights of the Republic of Indonesia, Director General of Intellectual Property Number: HKI-KI.06.07-11 dated 6 October 2020 in terms of removing the mark on the Initiative of the Minister. Second, the implementation of legal protection for owners of legal trademark rights certificates based on court decisions that have permanent legal force due to a third party lawsuit where the trademark holder has granted a license to another party, and legal protection for license holders is regulated in Article 48 of the Trademark Law.
