Abstract

Indonesia sudah memasuki era globalisasi dan perkembangan teknologi, khususnya untuk perkembangan praktik hukum agar dapat menjadi lebih efisien. Tanda tangan konvensional yang digunakan dalam perjanjian dalam bentuk dokumen kertas sudah mulai berganti menjadi tanda tangan digital pada perjanjian elektronik. Dalam pelaksanaan pembuatan perjanjiannya, para pihak sudah dapat melangsungkan pembuatan perjanjian dan berkomunikasi melalui sistem elektronik untuk membantu mengurangi biaya pengeluaran. Perjanjian yang dibuat melalui sistem elektronik juga dapat digunakan sebagai alat bukti elektronik di pengadilan. Notaris memiliki kewenangan untuk membuat perjanjian bagi para pihak, namun dalam bentuk yang sesuai dengan UUJN. Perbedaannya terletak pada kekuatan pembuktian perjanjian itu, dimana akta yang dibuat oleh para pihak dihadapan Notaris memiliki kekuatan pembuktian sempurna sebagai alat bukti terkuat di pengadilan. Ketentuan perundang-undangan terkait keabsahan akta Notaril dalam bentuk elektronik belum dapat berlangsung secara maksimal saat ini. Ketidakpastian dan tumpang tindihnya peraturan yang ada belum dapat melahirkan suatu kepastian hukum untuk melangsungkan konsep cyber Notary. Rumusan masalah penelitian ini, pertama, yaitu keabsahan penghadap dalam pembuatan akta Notaris secara fisik dan elektronik. Kedua, yaitu kekuatan pembuktian akta Notaris yang dibuat dengan kehadiran fisik dan elektronik penghadap. Analisa data penelitian ini yaitu deskriptif kualitatif dengan jenis penelitian normatif empiris. Data primer didapat dari hasil wawancara dengan Dr. Stefanie Hartanto, S.H., M.Kn. selaku Notaris di Kabupaten Tangerang, data sekunder dari studi kepustakaan. Hasil penelitian ini menunjukkan bahwa UUJN belum secara khusus mengatur mengenai praktik cyber Notary. Kewenangan Notaris dalam membuat akta secara elektronik juga masih banyak yang bertentangan dengan UU ITE. Kesimpulan dari penelitian ini, kehadiran pada pihak yang sah dan diakui dalam pembuatan perjanjian secara elektronik memiliki kekuatan pembuktian yang sama seperti akta Notaril, namun UUJN dan UU ITE belum memberikan kepastian hukum untuk pembuatan akta Notaris secara elektronik. Saran ditujukan untuk pertimbangan perubahan peraturan UUJN dan UU ITE agar dapat terlaksananya praktik Notaris secara elektronik. / Indonesia has entered the globalization era with the evolution of technology, specifically for the improvement in legal practice to become more efficient. Conventional signature which commonly used on paper based agreement have been shifted with a digital signature on electronic agreement. In the implementation to make an agreement, both parties can now communicate through an online system to draft and sign the agreement digitally to help them reduce their expenses for it. The agreement made with electronic system can also be used as an electronic evidence in court. Notary have the authority to make the written agreement for the parties, but in a different form as a Notarial deed. The difference lies in its evidentiary power, a Notarial deed that was made by the parties in the presence of a Notary have the strongest form of documentary evidence in court. The regulations in Indonesia regarding the validity of Notarial deed in form of electronic deed has many loopholes to be implemented at this time. The ambiguity and inadequancy in Notarial Law, and Electronic Information in Indonesia can not provide a legal certainty for Notary to practice the cyber notary concept. The formulation of the issues are, first, about validity of the parties in the making of Notarial deed with physical and virtual attendance. Second, about the evidentiary power of Notarial deed that was made by physical and virtual attendance. Analysis of the data in this study is a descriptive qualitative with the type of normative empirical research using primary data from interviewing Dr. Stefanie Hartanto, S.H., M.Kn. as a Notary in Tangerang district, and secondary data obtained from a literature study. The result of the study shows that UUJN has not specifically regulate cyber notary practice. The authority that Notary have to make Notarial deed as an electronic evidence had many loopholes regarding the regulation in UU ITE. In conclusion, virtual presence of parties in terms of private deed have the same evidentiary power as if it was made in Notarial deed. UUJN and UU ITE have not yet provide a legal certainty for Notary to make a authentic deed in electronic form. Suggestions are intended for The House of Representatives of the Republic of Indonesia to consider a revision for UUJN and UU ITE which regulates the validity of authentic deed and the evidential power of electronic Notarial deed as an evidence in court
