Abstract

Regarding the custody of underage children as a result of divorce which still occurs in Indonesia, there are still frequent problems regarding who has the right to obtain custody of children from these marriages. Marriage is the beginning of the journey of a husband and wife to form a family. The marriage of a husband and wife can be blessed with a child, with the birth of a child in the family, rights and obligations arise that must be carried out between parents and children. In family life it is not always harmonious, which can result in the breakup of the marriage. Dissolution of a marriage can cause problems related to child custody, and seeing who has the right to be guardian for the child. Divorce from both parents also results in the loss of the power of parents who turn into guardians. As a result of the divorce, the author will examine the protection and custody of minors as a result of divorce and whether child custody in Decision Number 318/PDT.G/2021/PN.JKT.TIM is in accordance with statutory regulations. From this problem, the author will discuss the custody of underage children due to divorce in terms of Law Number 23 of 2002 concerning child protection (Decision Number 318/PDT.G/2021/PN.JKT.TIM) using empirical normative legal methods with the type of "Judicial Case Study" using secondary and primary legal materials with the acquisition of data obtained through open structured interview techniques and the nature of data analysis which is qualitative in nature. The results of this study are that the child custody that occurs in this decision has fallen into the hands of the father because the mother is incompetent in obtaining such custody because it has been proven to have committed acts of domestic violence and the matter decided by the judge is in accordance with statutory regulations existing invitations. This reflects that child protection is prioritized in order to get good affection and protection. / Terkait hak asuh anak dibawah umur akibat perceraian yang masih terjadi di Indonesia masih sering terjadi permasalahan terkait siapa yang berhak memperoleh hak asuh anak dari perkawinan tersebut. Perkawinan merupakan awal mula perjalanan sepasanga suami isteri membentuk sebuang keluarga. Perkawinan dari sepasang suami isteri dapat dikaruniai seorang anak, dengan lahirnya seorang anak dalam keluarga muncul hak dan kewajiban yang harus dilaksanakan antara orang tua dan anak. Dalam kehidupan berkeluarga tidaklah selalu harmonis, yang dimana dapat mengakibatkan putusnya perkawinan. Putusnya perkawinan dapat menyebabkan permasalahan terkait hak asuh anak, dan melihat siapa yang berhak menjadi wali untuk anak tersebut. Perceraian dari kedua orang tua juga mengakibatkan hilangnya kekuasaan orang tua yang berubah menjadi wali. Akibat perceraian tersebut, penulis akan meneliti tentang perlindungan dan hak asuh anak dibawah umur akibat perceraian dan apakah hak asuh anak dalam Putusan Nomor 318/PDT.G/2021/PN.JKT.TIM telah sesuai dengan peraturan perundang- undangan. Dari permasalah ini, penulis akan membahas terkait hak asuh anak dibawah umur akibat perceraian ditinjau dari Undang-Undang Nomor 23 Tahun 2002 tentang perlindungan anak (Putusan Nomor 318/PDT.G/2021/PN.JKT.TIM) dengan menggunakan metode hukum normatif empiris dengan jenis “Judicial Case Study” menggunakan bahan hukum sekunder dan primer dengan perolehan data yang didapatkan melalui teknik wawancara terstruktur terbuka dan sifat analisis data yang bersifat kualitatif. Hasil dari penelitian ini adalah, hak asuh anak yang terjadi dalam putusan ini telah jatuh ketangan sang ayah dikarenakan sang ibu tidak cakap dalam mendapatkan hak asuh tersebut karena telah terbukti pernah melakukan tindakan kekerasan dalam rumah tangga dan hal yang diputuskan oleh hakim telah sesuai dengan peraturan perundang-undangan yang ada. Hal ini mencerminkan bahwa perlindungan anak sangat diutamakan agar mendapatkan kasih sayang dan perlindungan yang baik.
