Abstract

Notaris sebagai pejabat umum yang memiliki kewenangan membuat akta otentik, termasuk dalam hal pembuatan akta pelepasan hak berdasarkan Pasal 15 ayat 2 huruf f UUJN Tahun 2014. Suatu tanah garapan yang merupakan Eigendom Verponding jika terkena ketentuan Undang-Undang No. 1 Tahun 1958, dan tanah negara berasal dari bekas hak barat yang terkena ketentuan UUPA jo. Keppres No. 32 Tahun 1979, maka pemilik Eigendom Verponding yang tidak mengajukan permohonan pendaftaran tanahnya (konversi) menjadi tanah negara, dan yang menjadi prioritas kepemilikan atas tanah tersebut adalah subyek hukum yang menduduki tanah tersebut. Adapun kewajiban Notaris dalam memeriksa dokumen para pihak, khususnya tanah Eigendom Verponding tersebut menjadi teliti dalam suatu melakukan perbuatan hukum dengan akta yang diterbitkannya. Notaris dalam membuat akta harus berpedoman kepada UUJN dan Kode Etik, serta menerapkan asas kehati-hatian dalam membuat akta otentik. Dalam hal ini, Majelis Pengawas Daerah berperan aktif terhadap notaris untuk memberikan pengawasan, maupun pembinaan dengan ketentuan peraturan dan perundang-undangan dengan memberikan pembinaan dan pemeriksaan rutin yang dilakukan setiap tahunnya terhadap protokol akta, serta melakukan pembinaan terhadap notaris yang berperkara maupun pada saat pemeriksaan rutin kepada setiap kantornya, berdasarkan Pasal 1 ayat 6 UUJN Tahun 2014. Dalam penelitian ini penulis menggunakan metode penelitian yuridis normatif empiris dengan memperoleh data primer melalui wawancara dengan 4 (empat) orang diantaranya selaku Notaris Kabupaten Sukabumi, Staff Hukum dan Kepatuhan Perhutani KPH Bogor, serta Seksi Survey dan Pemetaan Kantor Pertanahan Kota Mataram. Hasil penelitian yang diperoleh dalam hal pembuatan akta notaris yang statusnya diatas kawasan hutan negara, haruslah teliti terhadap dokumen yang dilampirkan oleh para pihak. Bukan hanya membuat akta saja, Notaris harus mempunyai pengetahuan mengenai akta, serta mengetahui terhadap peraturan, khususnya peraturan pertanahan yang selalu diperbaharui. Pendapat penulis, diperlukannya suatu asas kehati-hatian tersebut menjadi tolak ukur suatu jabatan agar tidak menimbulkan kerugian. Pembuktian akta otentik yang dijadikan sebagai alat bukti tertulis di pengadilan dapat dinyatakan tidak sah, dapat dibatalkan atau batal demi hukum, karena ditemukannya cacat hukum dalam pembuatannya, baik secara formil maupun materiil. / Notary as a public official authorized to make authentic deeds, including in the case of making deed of waiver based on Article 15 verse 2 point f UUJN 2014. 1 of 1958, and state land originates from former western rights which are subject to the provisions of UUPA jo. Presidential Decree No. 32 of 1979, the owner of the Eigendom Verponding who did not submit an application for land registration (conversion) to become state land, and who had previously owned the land, was the legal subject who occupied the land. As for the Notary's obligation to examine the letters of the parties, especially the Eigendom Verponding land, so that they are thorough in carrying out legal actions with the deed they issue. In making a deed, a notary must be guided by the UUJN and the Code of Ethics, and apply the precautionary principle in making an authentic deed. In this case the Regional Supervisory Board plays an active role for notaries to provide sanctions, supervision, and guidance with statutory provisions by providing guidance and routine inspections which are carried out every year on deed protocols, as well as providing guidance to notaries. who are in litigation as well as during routine inspections for each position, based on verse 1 point 6 UUJN 2014. In this study the authors used normative empirical research methods by obtaining primary data through interviews with 4 (four) people including as Sukabumi District Notary, Legal and Compliance Staff of Perhutani KPH Bogor, as well as the Survey and Mapping Section of the Mataram City Land Office. The research results obtained in the case of making a notarial deed whose status is above the state forest area, must be careful with the documents attached by the parties. Not only making a deed, a notary must have knowledge of the deed, and know the regulations, especially land regulations that are always updated. According to the author, there needs to be a precautionary principle which is the benchmark for an attitude so as not to cause harm. Proving an authentic deed used as written evidence in court can be declared invalid, can be canceled or canceled by law, because legal defects were found in the making of it, both formally and materially.
