Abstract

Setiap pelaku usaha wajib melaksanakan tanggung jawab sosial dan lingkungan sebagaimana dijelaskan dalam UU Penanaman Modal. Konflik di Indonesia tentang tanggung jawab sosial dan lingkungan masih sering terjadi. Fenomena-fenomena yang terjadi misalnya jalanan rusak di aktivitas pertambangan, buruh yang tidak diberi jaminan kesehatan dan keselamatan, sampai dua puluh satu perusahaan tidak melaksanakan tanggung jawab sosial dan lingkungan. Berdasarkan hasil wawancara penelitian dari tiga narasumber yang bergerak di bidang pertambangan dan perkebunan kelapa sawit, didapatkan bahwa ketiganya telah melaksanakan tanggung jawab sosial dan lingkungan. Peraturan yang mengatur tentang tanggung jawab sosial dan lingkungan di Indonesia masih sangat minim dan belum spesifik. Implementasi tanggung jawab sosial dan lingkungan sekiranya perusahaan dapat memberdayakan masyarakat lokal dan meningkatkan kesejahteraan petani, memperhatikan dampak kebun plasma terhadap masyarakat dan perekonomian lokal dan bertanggung jawab dalam pembangunan keberlanjutan di Indonesia. Notaris memiliki peran penting dalam mendorong dan memfasilitasi implementasi tanggung jawab sosial dan lingkungan oleh perusahaan di Indonesia. Notaris berperan dalam pembuatan akta dan dokumen hukum yang mengatur kewajiban dan komitmen perusahaan terkait tanggung jawab sosial dan lingkungan. Peran notaris adalah memastikan kepatuhan perusahaan terhadap peraturan dan regulasi terkait tanggung jawab sosial dan lingkungan, serta memastikan transparansi dan akuntabilitas dalam pelaksanaan program-program tanggung jawab sosial dan lingkungan. / Every business actor is obliged to carry out corporate social responsibility as described in the Investment Law. Conflicts in Indonesia regarding corporate social responsibility still occur frequently. Phenomena that occur, for example damaged roads in mining activities, workers who are not given health and safety guarantees, up to twenty one companies do not carry out corporate social responsibility. Based on the results of research interviews with three informants engaged in mining and oil palm plantations, it was found that all three had carried out corporate social responsibility. Regulations governing corporate social responsibility in Indonesia are still very minimal and not specific. Implementation of corporate social responsibility, if the company can empower local communities and improve the welfare of farmers, pay attention to the impact of plasma plantations on the community and the local economy and be responsible for sustainable development in Indonesia. Notary have an important role in encouraging and facilitating the implementation of corporate social responsibility by companies in Indonesia. The notary plays a role in drawing up deeds and legal documents that regulate the company's obligations and commitments related to social and environmental responsibility. The notary's role is to ensure the company's compliance with rules and regulations related to social and environmental responsibility, as well as to ensure transparency and accountability in the implementation of social and corporate social responsibilityprograms.
