Abstract

Kepastian hukum merupakan tujuan pendaftaran tanah guna untuk menghindari sengketa konflik kepemilikan terhadap hak atas tanah dimasyarakat. Dalam Pasal 19 ayat (2) huruf c UUPA, dinyatakan sertipikat merupakan alat pembuktian yang kuat namun ketentuan ini tidak mutlak karena dalam stelsel negatif dalam UUPA memberikan kesempatan kepada yang merasa memiliki hak untuk menggugatnya kepengadilan dengan mengemukakan bukti-bukti hak yang dimilikinya, sementara dalam Pasal 96 ayat (1) dan (2) PP 18 Tahun 2021 mengatur verponding Indonesia ini diberikan waktu 5 tahun semenjak berlakunya peraturan pemerintah ini, Dan bila jangka waktu dimaksud berakhir maka alat bukti tertulis tanah bekas milik adat dinyatakan tidak berlaku dan hanya sebagai petunjuk dalam pendaftaran tanah. Berdasarkan uraian tersebut, maka permasalahan yang akan dianalisa penulis yaitu bagaimana kepastian hukum pembatalan sertipikat hak atas tanah yang tumpang tindih dengan verponding indonesia dalam hukum agraria nasional. Penelitian ini menggunakan metode penelitian hukum yuridis normatif serta dikaitkan dengan teori-teori hukum dan asas-asas hukum melalui jenis pendekatan peraturan undang-undang, pendekatan analisis, pendekatan kasus, pendekatan historis, dan pendekatan konseptual. Bahwa memperhatikan pada teori-teori dan peraturan undang-undangan. Pembatalan sertipikat dapat dilakukan oleh pejabat yang berwenang karena cacat administrasi atau cacat yuridis dan pelaksanaan putusan pengadilan yang inkracht. dalam UUPA hak-hak bekas barat diberikan waktu 20 tahun untuk dikonversi haknya dan telah berakhir dengan diterbitkannya Kepres 32 Tahun 1979, berdasarkan PP 18 tahun 2021 verponding Indonesia dinyatakan wajib mendaftarkan haknya dalam jangka waktu 5 tahun sejak tanggal 2 Februari 2021. Berdasarkan hal ini hendaknya masyarakat perlu diedukasi bahwa batas waktu konversi telah berakhir dan Verponding Indonesia agar segera didaftarkan haknya sampai dengan 2 Februari 2026 yang terhitung 5 tahun sejak PP 18 tahun 2021 diterbitkan./ Legal certainty is the goal of land registration in order to avoid disputes over ownership and conflicts over land rights in the community. In Article 19 paragraph (2) letter c of the UUPA, it is stated that a certificate is a strong means of proof, but this provision is not absolute because the negative set in the UUPA gives the opportunity to those who feel they have the right to sue in court by presenting evidence of the rights they have, while in Article 96 paragraphs (1) and (2) of PP 18 Year 2021, Indonesia is given 5 years from the entry into force of this government regulation, and if the said period expires, written evidence of former customary land is declared invalid and only serves as a guide in land registration. Based on this description, the problem to be analyzed by the author is how legal certainty overlaps with the cancellation of certificates of land rights in Indonesia under national agrarian law. This study uses normative juridical law research methods and is associated with legal theories and legal principles through the types of statutory approaches, analytical approaches, case approaches, historical approaches, and conceptual approaches. That paying attention to the theories and statutory regulations Certificate cancellation can be done by an authorized official because of an administrative or juridical defect or the implementation of a court decision that is in force. In the UUPA, the former western rights were given 20 years to convert their rights, which ended with the issuance of Presidential Decree 32 of 1979. Based on PP 18 of 2021, Indonesia is declared obligated to register its rights within 5 years from February 2, 2021. Based on this, the public should be educated that the conversion deadline has expired, prompting Indonesia to immediately register its rights until February 2, 2026, which will be 5 years since PP 18 of 2021 was issued.
