Abstract
Notaris sebagai pejabat dalam menjalankan profesi wajib mengikuti ketentuan undang-undang yang berlaku. Adapun pada Era Pandemic Covid-19 ini berdampak membuat pola hidup manusia mulai berubah termasuk pada profesi notaris sebagaimana dalam menjalankan profesinya dituntut untuk melakukan segala hal dari rumah melalui sistem informasi dan teknologi yang ada. Pada dasarnya, terjadi benturan antara ketentuan dalam pelaksanaan jabatan Notaris dengan adanya Covid-19 saat ini yang mengharuskan adanya pembatasan kontak fisik demi mengurangi dan menghentikan penyebaran Covid-19 ditengah masyarakat. Rumusan masalah pada penelitian ini membahas tentang bagaimana implikasi hukum akta notaris yang tidak dibacakan dan tidak ditandatangani secara bersamaan selama pandemic Covid-19 dan bagaimana tanggung jawab notaris atas akta yang tidak dibacakan dan tidak ditandatangani secara bersamaan selama masa pandemic Covid-19. Metode yang digunakan dalam penelitian ini adalah metode penelitian normative dengan menggunakan pendekatan perundang-undangan. Teknik perolehan data dengan cara studi pustaka. Dari hasil penelitian dapat disimpulkan bahwa implikasi hukum terhadap akta yang tidak dibacakan dan tidak ditandatangani para pihak secara bersamaan selama masa pandemic Covid-19 adalah menjadi tidak adanya kepastian waktu terhadap kesepakatan dari para pihak karena hal tersebut, sehingga dapat menimbulkan konsekuensi hukum akta tersebut dapat dibatalkan karena tidak memenuhi syarat formil pembuatan akta sebagaimana diatur dalam Pasal 1868 KUHPerdata, khususnya pada syarat yang mengharuskan para pihak hadir langsung dihadapan notaris secara fisik. / Notaries as public officials in carrying out their profession must follow the provisions of the applicable laws and regulations. As for the Era of the Covid-19 Pandemic, this has had an impact on changes in human life patterns, including the notary profession, because in carrying out their profession they are required to do everything from home through existing information and technology systems. Basically there is a conflict between the provisions in the implementation of the position of Notary and the current Covid-19 which requires restrictions on physical contact in order to reduce and stop the spread of Covid-19 in the community. The formulation of the problem in this study discusses the legal implications of notarial deeds that were not read and signed simultaneously during the Covid-19 pandemic and how the notary's responsibility for deeds that were not read and signed simultaneously during the Covid-19 pandemic. The method used in this study is a normative research method using a statutory approach. Data acquisition technique by way of literature study. From the results of the study it can be concluded that the legal complication for deed that was not read out and not signed by the parties simultaneously during the Covid-19 pandemic was the lack of certainty when the agreement was made by the parties because of this. , so that it can cause legal consequences for the cancellation of the deed because it does not meet the formal requirements for making a deed as stipulated in Article 1868 of the Civil Code, especially the conditions that require the parties to be physically present before a notary.
