Abstract

The purpose of the insurance is to reduce or even eliminate the financial risk. So when the customer experiences a detrimental burden, the insurance company will transfer the risk from the insured (customer). There are 2 parties, namely the insurer and the insured, the insurer is a party that has formal permission to carry out business activities by taking risks from other parties based on a policy; for this coverage, the risk insurer receives a premium from the party as the insured; Usually the insurer is an insurance company. The purpose of the establishment of the OJK is that all activities in the financial services sector are carried out in an orderly, fair, transparent, accountable manner and are able to create a financial system that grows in a sustainable and stable manner, and is able to protect the interests of consumers and the public. In addition, supervision from the OJK makes the agency's services healthier and more stable. But there are still companies that cheat, especially from the directors. In this research, the author uses normative legal methods with secondary data in the form of books, law and regulations, journals, and other data obtained from library research. Based on the result of the analysis, through several cases that occurred in the community, especially cases regarding corporations or insurance companies that committed criminal acts in the financial services sector (forgery of documents and spreading false information to consumers or policy recipients). When viewed from its authority, OJK has the authority to supervise, regulate, examine and investigate if there is something that is suspected of being a violation of the law. Matters regarding the authority of the OJK have been clearly stated in article 1 number 1 in the OJK law.
