Abstract

Penelitian ini bertujuan untuk mengkaji kedudukan hukum Surat Pernyataan Penguasaah Fisik Tanah (SPPF) berdasarkan Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang dan mengkaji putusan yang berkaitan dengan permasalahan SPPF tersebut yaitu Putusan Nomor 3420 K/Pdt/2015. Hasil penelitian ini menujukkan SPPF memiliki kedudukan hukum sebagai sebagai satu-satunya alat bukti dalam proses pendaftaran tanah atas tanah bekas hak barat dan tanah bekas milik adat, yang menggantikan seluruh alat bukti tanah bekas hak barat dan tanah bekas milik adat yang dicabut kekuatan hukumnya. Sehingga SPPF menjadi satu-satunya alat bukti yang digunakan dalam proses pendaftaran tanah bekas hak barat dan tanah bekas milik adat. Putusan Nomor 3420 K/Pdt/2015 yang ditetapkan oleh majelis hakim, yang memutuskan Sertifikat Hak Guna Usaha merupakan alas hak atau alat bukti kepemilikan tanah yang sah dan membatalkan keberlakuan SPPF telah sesuai dengan PP No. 24 Tahun 1997 dimana SPPF berkedudukan sebagai alat bukti pelengkap. Akan tetapi, bila ditinjau dari PP No. 18 Tahun 2021, dimungkinkan bahwa SPPF dapat dianggap menjadi alas bukti kepemilikan tanah yang sah. / This research aims to examine the legal position of the Statement Letter of Physical Land Ownership (SPPF) based on Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation into Law and examine decisions related to the SPPF issue, namely Decision Number 3420 K/Pdt/2015. The results of this study indicate that SPPF has a legal standing as the only evidence in the process of land registration towards former western rights and former customary land, which replaces all evidence of former western rights and former customary land that no longer enforceable. So that SPPF is the only evidence in the process of land registration towards former western land rights and former customary land. Decision No. 3420 K/Pdt/2015 that enacted by the panel of judges, which decided that the Rights to Use (HGU) is a valid legal title or the evidence for land ownership in which has cancelled the validity of the SPPF, was in accordance with PP No. 24 of 1997 where the SPPF was positioned as complementary evidence. However, when viewed from PP No. 18 of 2021, it is possible that the SPPF can be considered a valid proof of land ownership.
