Abstract

Penyelesaian sengketa terkait kejahatan skimming oleh lembaga perbankan berdasarkan Peraturan Bank Indonesia dan Peraturan Otoritas Jasa Keuangan dilakukan pada saat terdapat para pihak yang tidak puas terhadap kesepakatan yang dilakukan oleh penyelenggara, terlebih pada saat pemenuhan haknya atas kepercayaan konsumen selaku nasabah perbankan yang menaruh uangnya di lembaga perbankan selaku pelaku jasa keuangan namun mengalami kerugian karena kejahatan skimming. Penelitian ini menggunakan metode penelitian yuridis normatif. Penelitian dengan pendekatan yuridis normatif tersebut mengkaji data-data yang berasal atau bersumber dari norma-norma hukum yang terdapat pada masyarakat serta terdapat pada peraturan perundang-undangan. Pada penelitian ini juga akan melakukan wawancara dengan pihak-pihak yang berkaitan dengan Bank Indonesia. Kesimpulan dari penelitian ini adalah Mekanisme penyelesaian sengketa di luar pengadilan terkait kejahatan skimming merupakan kewenangan Bank Indonesia untuk menyelesaikan kejahatan tersebut yang mana konsumen dapat menyampaikan melakukan upaya penyelesaian tersebut dengan cara mediasi maupun arbitrase. Pada penanganan sengketa harus mempertimbangkan unsur kerugian yang dialami oleh pihak nasabah berdasarkan aturan hukum sesuai dengan peraturan perundang-undangan yang menjadi dasar perlindungan hukum bagi nasabah yang mengalami kerugian finansial akibat kesalahan dari sistem bank. / Settlement of disputes related to skimming crimes by banking institutions based on Bank Indonesia Regulations and Financial Services Authority Regulations is carried out when there are parties who are dissatisfied with the agreement made by the operator, especially during the fulfillment of their right to consumer trust as banking customers who put their money in banking institutions as financial service actors but suffer losses due to skimming crimes. This research uses normative juridical research methods. Research with a normative juridical approach examines data derived from or sourced from legal norms found in society and contained in laws and regulations. This study will also conduct interviews with parties related to Bank Indonesia and the Financial Services Authority. The conclusion of this study is that the dispute resolution mechanism out of court can be carried out by the operator, and consumers can submit complaints to dispute resolution bodies or institutions or to Bank Indonesia. In handling disputes it must consider the elements of losses suffered by the customer based on the rule of law in accordance with the laws and regulations which are the basis of legal protection for customers who experience financial losses due to errors in the bank system.
