Abstract

Penelitian ini bertujuan untuk menganalisis penerapan kewajiban refuge floor pada bangunan gedung yang telah terbangun dan memiliki IMB sebelum diterbitkannya Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 14 Tahun 2017 tentang Persyaratan Kemudahan Bangunan Gedung yang dimana karena adanya kewajiban ketersediaan refuge floor menyebabkan pemilik bangunan gedung mengalami kesulitan dalam pengurusan Sertifikat Laik Fungsi (SLF), mengingat perubahan atas konstruksi bangunan gedung tidak dimungkinkan sehingga harus adanya kepastian hukum mengenai dilantai berapakah refuge floor dapat disediakan karena didalam Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 14 tahun 2017 tentang Persyaratan Kemudahan Bangunan Gedung diatur refuge floor harus disediakan di interval lantai 16. Penelitian ini menggunakan pendekatan hukum normatif-empiris dengan mengacu kepada peraturan perundang-undangan, penetapan pengadilan, serta kasus yang telah terjadi. Penelitian ini menggunakan teori kepastian hukum, teori keadilan hukum dan teori kepatuhan hukum untuk menganisis penerapan asas keamanan dan keselamatan bagi konsumen sebagai penghuni bangunan gedung yang tidak memiliki refuge floor dikaitkan dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan juga terhadap penyesuaian yang harus dilakukan oleh pemilik bangunan gedung atas diwajibkannya ketersediaan refuge floor, sehingga dengan adanya penelitian ini diharapkan kedepannya terdapat suatu ketentuan pelaksana teknis untuk seluruh wilayah di Negara Indonesia atas setiap Peraturan yang dikeluarkan oleh Pemerintah sehingga tidak adanya ketidakpastian hukum yang menimbulkan kerugian bagi pelaku usaha ataupun bagi konsumen. / This research aims to analyze the application of the refuge floor obligation in buildings that have been built and have IMB before the issuance of the Regulation of the Minister of Public Works and Public Housing Number 14 of 2017 concerning Building Facility Requirements which due to the obligation to provide a refuge floor causes building owners to experience difficulties in obtaining a Certificate of Worthiness (SLF), considering that changes to building construction are not possible so that there must be legal certainty regarding which floor the refuge floor can be provided because in the Regulation of the Minister of Public Works and Public Housing Number 14 of 2017 concerning Building Facility Requirements it is regulated that the refuge floor must be provided at the 16th floor interval. This research uses a normative-empirical legal approach by referring to laws and regulations, court decisions, and cases that have occurred. This research uses the theory of legal certainty, the theory of legal justice and the theory of legal compliance to analyze the application of the principle of security and safety for consumers as occupants of buildings that do not have a refuge floor associated with Law Number 8 of 1999 concerning Consumer Protection and also to the adjustments that must be made by building owners for the mandatory availability of refuge floors, so that with this research it is hoped that in the future there will be a provision of a refuge floor.
