Abstract

Penelitian ini bertujuan untuk mengetahui kedudukan hukum kurir dalam kegiatan jual beli secara online, terutama dalam sistem pembayaran Cash On Delivery (COD), dan untuk mengetahui perlindungan hukum yang dapat diberikan kepada kurir dalam sistem pembayaran COD, terlebih perlindungan hukum bagi kurir terhadap pembeli yang tidak memahami dengan baik seperti apa sistem pembayaran COD dan karena kurangnya pemahaman yang baik akan sistem COD, maka beberapa pembeli menolak untuk membayar saat dilihat bahwa paket tidak sesuai pesanannya. Hal tersebut berdampak bagi Kurir yang hanya merupakan perantara antara penjual dan pembeli. Penelitian yang digunakan dalam skripsi ini adalah metode yuridis normatif dengan cara meneliti bahan-bahan pustaka atau sumber data sekunder, yaitu peraturan perundang-undangan, buku-buku, dan penelitian- penelitian hukum. Hasil penelitian menunjukkan bahwa COD merupakan sistem pembayaran yang telah disepakati oleh pihak penjual dan pembeli dimana pembeli berkewajiban untuk melakukan pembayaran di tempat. Dan kedudukan hukum kurir dalam COD adalah sebagai pihak ketiga yaitu perantara yang menerima titipan, sebagai orang yang menggantikan perusahaan jasa pengiriman barang dalam menjalankan kuasa dari penjual, dan sebagai penerima pembayaran dari pembeli. Perlindungan hukum yang dapat diberikan kepada kurir dalam sistem COD adalah dengan menjamin bahwa kurir tidak dibebankan tanggung jawab atas ketidaksesuaian atau kerusakan barang yang bukan disebabkan oleh kesalahan atau kelalaiannya / This study aims to determine the legal position of couriers in online buying and selling activities, especially in the Cash On Delivery (COD) payment system, and to determine the legal protection that can be given to couriers in the COD payment system, especially legal protection for couriers against buyers who do not understand well what the COD payment system is like and because of a lack of good understanding of the COD system, some buyers refuse to pay when they see that the package is not what they ordered. This has an impact on Couriers who are only intermediaries between sellers and buyers. The results of the study show that COD is a payment system that has been agreed upon by the seller and the buyer where the buyer is obliged to make payments on the spot. And the legal position of the courier in COD is as a third party, namely the intermediary who receives the deposit, as a person who replaces the goods delivery service company in carrying out the power of attorney from the seller, and as a recipient of payment from the buyer. The legal protection that can be given to couriers in the COD system is to guarantee that the courier is not responsible for non-conformance or damage to goods that are not caused by his mistakes or negligence.
