Abstract

Kekurangan anggaran negara untuk dana pembangunan di Indonesia menjadi permasalahan karena Indonesia memerlukan pembiayaan yang besar untuk memenuhi kebutuhan pembangunan strategis. Diperlukan suatu solusi yang nyata dan sesegera mungkin dari pihak manapun agar Indonesia mampu memperoleh alternatif pembiayaan yang dibutuhkan tersebut. Dalam upayanya mengatasi permasalahan tersebut, Pemerintah pun melakukan suatu gebrakan dari sisi peraturan perundang-undangan dan kelembagaan. Seiring dengan kelahiran Undang-Undang Nomor 11 tahun 2020 tentang Cipta Kerja (yang sudah diganti dengan UU No. 6 tahun 2023 dan selanjutnya disebut dengan istilah “Omnibus Law”), melaluinya Pemerintah membentuk suatu lembaga sui generis yang secara khusus bertugas untuk mencari dan menarik dana pembiayaan dan investasi yang dibutuhkan sehubungan dengan pembangunan-pembangunan infrastruktur atau sektor investasi strategis di Indonesia. Lembaga ini mengikuti model Sovereign Wealth Fund yang telah terlebih dahulu ada di negara-negara maju ataupun berkembang di dunia. Lembaga yang dibentuk dengan Omnibus Law ini dikenal dengan istilah “Lembaga Pengelola Investasi” atau “Indonesia Sovereign Wealth Fund” atau “Indonesia Investment Authority” (selanjutnya disebut sebagai “LPI”). LPI pun bergabung menjadi anggota International Forum on Sovereign Wealth Funds yang telah menerbitkan Santiago Principles, prinsip dan praktik mengenai SWF secara global. Sebagai anggota, LPI pun perlu melihat keselarasan pengaturannya dengan Prinsip Santiago yang diterima secara global sebagai panduan pengaturan mengenai SWF. Penelitian ini bertujuan untuk mengetahui pengaturan peraturan perundang-undangan tentang LPI dan keselarasannya dengan Prinsip Santiago. Penelitian ini dilakukan dengan metode yuridis normatif. Mengenai pengaturan LPI sebagai Sovereign Wealth Fund, pengaturannya dapat dilihat dalam Omnibus Law dan Peraturan Pemerintah Nomor 74 Tahun 2020 tentang Lembaga Pengelola Investasi. Pengaturan LPI telah memiliki keselarasan dengan Prinsip Santiago walaupun diperlukan pengaturan lebih lanjut bagi sebagian Prinsip Santiago yang belum tercakup dalam pengaturan LPI saat ini. / The lack of state funding in relation to development budget in Indonesia becomes a serious problem for Indonesia with their necessity to require massive financing to undertake their strategic development. It is a mandatory to conclude a concrete solution and in promptly manner so that Indonesia may attract the alternative fundings for their needs. With regards to that matter, the Government of Indonesia made some breakthrough in regulatories and organization. In line with the enactment of the Law No. 11 of 2020 on Employment Creation (which has been revoked and substituted with the Law No. 6 of 2023, which hereinafter shall be referred as the “Omnibus Law”), the Government created a sui generis body specific for attracting the investment and financing funds that necessary for infrastructure projecs or any other strategic investment in Indonesia. This body remodels a Sovereign Wealth Fund in which has been established before in other developed or developing countries in the world. This body which established under the Omnibus Law is recognized as “Indonesia Investment Authority” or “Indonesia Sovereign Wealth Fund” (hereinafter called as “LPI”). LPI then joined as member of International Forum on Sovereign Wealth Funds which formulated Santiago Principles, the set of principles and practices on SWF among global. As a member, LPI need to understand its adherence of regulation with the Santiago Principles that accepted globally as global guidance on SWF. This research is intended to understand the regulatories provision on LPI and its adherence with the Santiago Principles. This research is conducted with the normative yuridical approach. Related to LPI regulation as Sovereign Wealth Fund, the regulation may be referred in the Omnibus Law and the Government Regulation No. 74 of 2020 on LPI. LPI regulation has adhered with the Santiago Principles given that it is necessary to further regulate some part of the Santiago Principles that has not been accommodated in the current prevailing LPI regulation.
