Abstract

The purpose of the research in this scientific work is to find out the criminal responsibility for spreading online prostitution advertisements in terms of Law no. 19 of 2016 concerning Amendments to Law no. 11 of 2008 concerning Information and Electronic Transactions as well as efforts to deal with the crime of spreading online prostitution advertisements in Indonesia. The research method used in this scientific work is normative legal research by examining library materials. The type of data used in this scientific work consists of secondary data as research material which the authors obtain from existing data sources such as literature studies consisting of laws, law books and legal journals. The type of approach used in this scientific work is a legal systematic approach by conducting research on legal systematics. The research results obtained in this scientific work are that the form of criminal responsibility for spreading online prostitution advertisements in terms of Law no. 19 of 2016 concerning Amendments to Law no. 11 of 2008 concerning Information and Electronic Transactions has been contained in Article 45 paragraph (1) although not specifically but can be linked to content that violates immorality where perpetrators can be legally processed and fined based on these rules, in other efforts can also be given for handling the crime of spreading online prostitution advertisements in the form of penal and non-penal measures that are repressive and preventive in nature in order to eradicate and prevent the criminal act of spreading online prostitution advertisements. But still, from a legal perspective, there is no law that specifically regulates the criminal act of spreading online prostitution advertisements, so that in this case it is hoped that the government and law enforcement officials will pay more attention to law enforcement, especially for online prostitution and its distribution so that penal efforts can be more be improved and non penal can also follow to provide more prevention so that people are more educated and aware of this./ Tujuan dari penelitian dalam karya ilmiah ini adalah untuk mengetahui pertanggungjawaban pidana penyebaran iklan prostitusi online ditinjau dari Undang-Undang No. 19 Tahun 2016 tentang Perubahan atas Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik dan juga upaya penanggulangan pidana penyebaran iklan prostitusi online di Indonesia. Metode penelitian yang digunakan dalam karya ilmiah ini adalah penelitian hukum normatif dengan meneliti bahan Pustaka. Jenis data yang digunakan dalam karya ilmiah ini terdiri dari data sekunder sebagai bahan penelitian yang penulis peroleh dari sumber-sumber data yang telah ada seperti studi kepustakaan yang terdiri dari Undang-Undang, buku hukum dan jurnal hukum. Jenis pendekatan yang digunakan dalam karya ilmiah ini adalah pendekatan sistematika hukum dengan melalukan penelitian terhadap sistematika hukum. Hasil penelitian yang diperoleh dalam karya ilmiah ini adalah bahwa bentuk pertanggungjawaban pidana penyebaran iklan prostitusi online ditinjau dari Undang-Undang No. 19 Tahun 2016 tentang Perubahan atas Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik telah dimuat dalam Pasal 45 ayat (1) walaupun tidak secara spesifik namun dapat dikaitkan dengan muatan yang melanggar asusila dimana para pelaku dapat diproses secara hukum dan mendapatkan sanksi denda berdasarkan aturan tersebut, dalam upaya lain juga dapat diberikan untuk penanganan tindak pidana penyebaran iklan prostitusi online berupa upaya penal dan non penal yang bersifat represif dan preventif guna memberantas dan mencegah terjadinya tindak pidana penyebaran iklan prostitusi online. Namun tetap saja dari segi hukumnya sendiri belum ada Undang-Undang yang secara spesifik mengatur mengenai tindak pidana penyebaran iklan prostitusi online ini sehingga dalam hal tersebut diharapkan untuk pemerintah dan aparat penegak hukum lebih memperhatikan penegakan hukum khususnya untuk prostitusi online dan penyebarannya sehingga upaya penal dapat lebih ditingkatkan dan secara non penal juga dapat menyusul untuk memberikan lebih banyak pencegahan sehingga masyarakat lebih teredukasi dan menyadari akan hal ini.
