Abstract

The environment and waste management in the city of Medan are the focus of the author's research. The aim of the research is to increase knowledge about environmental legal aspects in the 4R (Reduce, Reuse, Recycle, Recovery) environmental management program and to understand the implementation of 4R (Reduce, Reuse, Recycle, Recovery) waste management in Medan City. The research method used in this study is a normative-empirical legal research method that combines normative elements (laws, books, and other library sources) and empirical (social). The types of data used are primary data and secondary data which are divided into primary legal materials, secondary legal materials, and tertiary legal materials. The data collection method was carried out by interviewing informants from the Medan City Environment Service and literature studies to support the interview results. Analysis of research data using a qualitative method, which processes data from the literature in the form of laws and regulations, legal expert opinions, theories and legal norms, as well as 4R articles. The results of this study are that environmental legal aspects in environmental management lead to supervision carried out by the Medan City Environmental Service such as monitoring at the TPA every month and checking leachate in each area. Efforts made by the government in implementing the 4R program (Reduce, Reuse, Recycle, Recovery) are providing socialization and education to each region on a regular basis in order to increase public knowledge about waste management and environmental ethics. The 4R waste management program in Medan City is in the process of making efforts for all people to run it, education and guidance is needed for the community so that this program can run in Medan City./ Lingkungan hidup dan pengelolaan sampah di Kota Medan menjadi fokus penelitian penulis. Tujuan penelitian untuk menambah pengetahuan tentang aspek hukum lingkungan dalam program pengelolaan lingkungan hidup 4R (Reduce, Reuse, Recycle, Recovery) serta memahami tentang pelaksanaan pengelolaan sampah 4R (Reduce, Reuse, Recycle, Recovery) di Kota Medan. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif-empiris yang menggabungkan unsur normatif (undang-undang, buku, dan sumber pustaka lainnya) dan empiris (sosial). Jenis data yang digunakan berupa data primer dan data sekunder yang terbagi atas bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Cara perolehan data dilakukan dengan metode wawancara pada narasumber dari Dinas Lingkungan Hidup Kota Medan dan studi kepustakaan untuk mendukung hasil wawancara. Analisis data hasil penelitian menggunakan metode kualitatif, yang mengolah data dari kepustakaan berupa peraturan perundang-undangan, pendapat ahli hukum, teori, dan norma hukum, serta artikel 4R. Hasil penelitian dari penelitian ini yaitu aspek hukum lingkungan dalam pengelolaan lingkungan hidup mengarah terhadap pengawasan yang dilakukan oleh Dinas Lingkungan Hidup Kota Medan seperti pemantauan di TPA setiap bulan serta mengecek air lindi yang ada di setiap daerah. Upaya yang dilakukan oleh pemerintah dalam melaksanakan program 4R (Reduce, Reuse, Recycle, Recovery) yaitu memberikan sosialisasi dan edukasi ke tiap-tiap daerah secara rutin guna untuk meningkatkan pengetahuan masyarakat tentang pengelolaan sampah dan etika lingkungan. Program pengelolaan sampah 4R di Kota Medan dalam proses diupayakan agar semua masyarakat menjalankannya, diperlukannya edukasi dan bimbingan kepada masyarakat agar terjalannya program ini di Kota Medan.
