Abstract

The purpose of this study is to find out and analyze the considerations of the Panel of Judges regarding the Work Agreement for fixed term emploment (Work Contract) between Workers and employers and to find out and describe the implementation of Workers' rights in resolving disputes over Termination of Employment in Decision Number 190 K/Pdt.Sus-PHI/2021. This research is a normative juridical research, which is carried out by conducting library research. The data used is secondary data in the form of primary legal materials, namely the relevant laws and regulations and the Supreme Court Decision No. 190K/Pdt.Sus-PHI/2021, secondary legal materials in the form of legal theories, expert opinions, research results, and tertiary legal materials in the form of dictionaries. The data obtained was analyzed qualitatively using a statutory approach and case studies in decisions. The results of the study show that the consideration of the Panel of Judges regarding the Specific Time Work Agreement between employers and workers who have worked continuously for 8 years and 1 month without a break has correctly applied the law, which is contrary to Article 59 Paragraph (7) of Law No. 13 of 2003 concerning Manpower, therefore by law it becomes an Unspecified Time Work Agreement. Implementation of Workers' rights due to layoffs in Decision Number 190 K/Pdt.Sus-PHI/2021 jo. Decision Number 51/Pdt.Sus-PHI/2020/PN.Srg in general has been realized because layoffs did not occur because of the end of the contract but because of company efficiency so that based on Article 164 of Law No. 13 of 2003 concerning Manpower, Employers are obliged to pay severance pay, gratuity pay and compensation pay according to Article 156 paragraphs (2), (3) and (4) of Law no. 13 of 2003 concerning Manpower. The right to processing wages and the lack of payment of wages in 2017 and 2018 because they were paid below the Serang City Minimum Wage were not considered by the Panel of Judges, they should be legally based to be implemented on the legal basis of Article 151 paragraph (3) jo. Article 155 paragraph (2) jo. Constitutional Court Decision No. 37/PUU-IX/2011 and Article 96 of Law no. 13 of 2003 concerning Manpower jo. Constitutional Court Decision No. 100/PUU-X/2012. / Tujuan penelitian ini adalah untuk mengetahui dan menganalisis pertimbangan Majelis Hakim tentang Perjanjian Kerja Waktu Tertentu (Kontrak kerja) antara Pekerja dengan pengusaha dan untuk mengetahui dan menggambarkan implementasi hak-hak Pekerja dalam penyelesaian perselisihan Pemutusan Hubungan Kerja pada Putusan Nomor 190 K/Pdt.Sus-PHI/2021. Penelitian ini adalah penelitian yuridis normatif, yang dilakukan dengan cara melakukan penelitian kepustakaan. Data yang digunakan adalah data sekunder berupa bahan hukum primer, yakni peraturan perundang-undangan yang terkait dan Putusan Mahmamah Agung No. 190K/Pdt.Sus-PHI/2021, bahan hukum sekunder berupa teori hukum, pendapat para ahli, hasil penelitian, dan bahan hukum tersier berupa Kamus. Data yang diperoleh dianalisis secara kualitatif dengan pendekatan perundang-undangan dan studi kasus dalam putusan. Hasil penelitian menunjukkan bahwa pertimbangan Majelis Hakim tentang Perjanjian Kerja Waktu Tertentu antara pengusaha dengan pekerja yang telah bekerja selama 8 tahun 1 bulan secara terus menerus tanpa jeda telah tepat menerapkan hukumnya yaitu bertentangan dengan Pasal 59 Ayat (7) Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan oleh karenanya demi hukum menjadi Perjanjian Kerja Waktu Tidak Tertentu. Implementasi hak-hak Pekerja akibat PHK pada Putusan Nomor 190 K/Pdt.Sus-PHI/2021 jo. Putusan Nomor 51/Pdt.Sus-PHI/2020/PN.Srg secara umum telah diwujudkan karena PHK bukan terjadi karena berakhirnya kontrak melainkan dikarenakan efisiensi perusahaan sehingga berdasarkan Pasal 164 Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan, Pengusaha berkewajiban untuk membayar uang pesangon, uang penghargaan masa kerja dan uang penggantian hak berdasarkan Pasal 156 ayat (2), (3) dan (4) Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan. Hak atas upah proses dan kekurangan pembayaran upah tahun 2017 dan tahun 2018 karena dibayar di bawah Upah Minimum Kota Serang tidak dipertimbangkan oleh Majelis Hakim, seharusnya berdasar secara hukum untuk diimplementasikan dengan dasar hukum Pasal 151 ayat (3) jo. Pasal 155 ayat (2) jo. Putusan Mahkamah Konstitusi No. 37/PUU-IX/2011dan Pasal 96 Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan jo. Putusan Mahkamah Konstitusi No. 100/PUU-X/2012.
