Abstract

The purpose of this study was to find out and analyze the considerations of the Panel of Judges regarding the Cancellation of the Kangaroo Mark and the legal consequences of canceling the registration of the Kangaroo mark in Decision Number 534 K/PDT.SUS.HKI/2019. The legal research method used in this research is normative juridical research which is research conducted or aimed only at written regulations with the nature of analytical descriptive research which is a method that functions to describe or give an overview of the object under study through data or samples and make general conclusions. The source of data used in this study is primary data analysis of qualitative data which is an observation of phenomena obtained from the data obtained in the form of descriptions, information and or writing. The results of this study are the legal consequences of canceling the registration of the Mark of Decision Number 534K/Pdt.Sus.HKI/2019 jo. Decision Number 19 /Pdt.Sus/Brand/2018/PN.Niaga.Jkt.Pst is the consideration of the Panel of Judges to reject the lawsuit from the plaintiff according to the existing judex facti because the plaintiff did not provide sufficient evidence to file a trademark cancellation based on article 74 Trademarks and Geographical Indications Act. However, more consideration should be given to international regulations that also apply in Indonesia, such as the Paris convention and the TRIPS Agreement. The consequence that emerged from the rejection of this lawsuit was that the defendant obtained full power over the kangaroo mark which should have been in accordance with applicable international regulations a brand that should have been owned by the plaintiff. Based on article 6 bis of the Paris Convention (1967) and article 16 paragraph (3) of the TRIPS Agreement, the defendant's mark cannot be registered in Indonesia because the plaintiff has registered the mark in the country of origin. / Tujuan penelitian ini adalah untuk mengetahui dan menganalisis pertimbangan Majelis Hakim tentang Pembatalan Merek Kangaroo dan akibat hukum dari pembatalan pendaftaran merek Kangaroo pada Putusan Nomor 534 K/PDT.SUS.HKI/2019. Metode penelitian hukum yang digunakan dalam penelitian ini adalah penelitian yuridis normatif yang merupakan penelitian yang dilakukan atau di tujukan hanya pada peraturan-peraturan yang tertulis dengan sifat penelitian deskriptif analisis yang merupakan suatu metode yang berfungsi untuk mendeskripsikan atau memberi gambaran terhadap objek yang diteliti melalui data atau sampel dan membuat kesimpulan yang berlaku untuk umum. Sumber data yang digunakan dalam penelitian ini adalah data primer analisis data kualitatif yang merupakan pengamatan fenomena yang di peroleh dari data-data yang di peroleh dalam bentuk uraian, informasi dan atau tertulisan. Hasil dari penelitian ini adalah akibat hukum dari pembatalan pendaftaran merek Putusan Nomor 534K/Pdt.Sus.HKI/2019 jo. Putusan Nomor 19 /Pdt.Sus/ Merek/2018/PN.Niaga.Jkt.Pst adalah pertimbangan Majelis Hakim untuk menolak gugatan dari penggugat menurut judex facti yang ada sudah tepat dikarenakan penggugat tidak memberikan bukti yang cukup untuk mengajukan pembatalan merek berdasar pada pasal 74 Undang undang Merek dan Indikasi Geografis. Namun harus lebih dipertimbangkan lagi akan peraturan Internasional yang berlaku juga di Indonesia seperti Paris convention dan TRIPs Agreement . Akibat yang muncul dari penolakan gugatan ini adalah tergugat memperoleh kekuasaan penuh atas merek kangaroo yang seharusnya sesuai dengan peraturan Internasional yang berlaku merupakan merek yang seharusnya dimiliki oleh penggugat. Jika didasarkan pada pasal 6 bis Konvensi Paris (1967) dan pasal 16 ayat (3) TRIPs Agreement seharusnya merek milik tergugat tidak bisa didaftarkan di Indonesia dikarenakan penggugat telah terlebih dahulu mendaftarkan merek tersebut di negara asal.
