Abstract

Bhayangkari adalah organisasi istri Polisi, siapapun yang menikah dengan anggota Polri, secara kohesif melekat dalam dirinya menjadi anggota Bhayangkari. Sebagai anggota Bhayangkari diwajibkan mendampingi suami di manapun bertugas. Permasalahan timbul apabila yang menjadi istri Polisi adalah seorang Polwan karena sebagai anggota Polri, Polwan diharuskan mengutamakan kepentingan bangsa dan negara daripada kepentingan pribadi, seseorang, dan/atau golongan. Penelitian ini ingin mengetahui norma pengaturan hukum yang berlaku di Kepolisian maupun Bhayangkari terhadap Polwan yang menjalankan peran ganda selaku anggota Polri dan anggota Bhayangkari serta implementasinya. Metode penelitian yang digunakan adalah penelitian hukum normatif empiris (empirical normative legal reseach) dengan menggunakan data sekunder berupa bahan hukum primer, sekunder, dan tersier serta didukung oleh data primer. Penelitian dalam tesis ini adalah “penelitian deskriptif analitis” bertujuan untuk memberi uraian deskriptif hasil analisis. Teknik pengumpulan data melalui studi kepustakaan dan wawancara kepada 202 narasumber. Penelitian ini dilakukan dengan pendekatan terhadap sistem hukum, sinkronisasi hukum, dan perbandingan lintas negara. Hasil penelitian ditemukan adanya disharmoni hukum antara peraturan yang ada dalam Bhayangkari dengan peraturan yang ada di Kepolisian terkait Polwan yang merangkap sebagai Bhayangkari. Peraturan di Bhayangkari tidak berpedoman pada peraturan yang ada di Kepolisian, Polwan diwajibkan berada di tempat suami bertugas tanpa mengacu pada peraturan yang ada di Polri. Peraturan di Kepolisian belum mengatur secara khusus terkait Polwan yang berprofesi ganda sebagai Bhayangkari. Sama dengan negara lainnya, Polwan Indonesia juga menghadapi hambatan karir terkait isu gender, stereotip, sosial (sistem patriarki), dan budaya. Agar tidak menimbulkan konflik peran, dilema hierarki, dan pengambilan keputusan. Disarankan untuk membuat Peraturan Kepala Kepolisian Negara Republik Indonesia (Perkap/Peraturan Kapolri) khusus mengatur Polwan yang merangkap sebagai Bhayangkari. Pasal 2 ayat a. butir 2.c. Anggaran Rumah Tangga Bhayangkari perlu direvisi. / Bhayangkari is the organization of Police wives, anyone who married to a Policeman then cohesively attaches to be a member of Bhayangkari. As a member of Bhayangkari is obliged to accompany her husband wherever he is on duty. Problems arise if the wife of the Police is a Policewoman because as a member of the National Police she is required to prioritize the interests of the nation and state over personal, private, and/or group interests. This research wants to know the norms of legal regulation for Policewomen who carry out dual roles as members of the National Police and members of Bhayangkari and their implementation. The research method is empirical normative legal research using secondary data in the form of primary, secondary, and tertiary legal materials and supported by primary data. Research in this thesis is "analytical descriptive research" aims to provide a descriptive description of the results of the analysis. Data collection techniques through literature studies and interviews with 202 resource persons. This research was conducted with an approach to the legal system, legal synchronization, and cross-country comparison. The results of the research, found legal disharmony between the Bhayangkari regulations and the Police regulations. Bhayangkari Regulations are not guided by existing regulations in the Police, Policewomen are required to be at the place where their husbands are on duty without referring to Police Regulations. There is no regulation specifically related to Policewomen who double as Bhayangkari. Like other countries, Indonesian Policewomen also face career barriers related to gender, stereotypes, social (patriarchal systems), and cultural issues. So as not to cause role conflicts, hierarchical dilemmas, and decision making problem. It is recommended to make a regulation from Chief of Indonesian Police specifically regulating Policewomen who concurrently serve as Bhayangkari. Article 2 paragraph a. point 2.c. the Bylaws of Bhayangkari need to be revised.
