Abstract
In order to develop the country and bring prosperity to its citizens, Indonesia establish state financial system, including management of national income and expenditure. In this regard, the act of corruption brought losses to the national fund. Legally, those who committed to corruption have to be responsible for their act and replace the loss of national funds. This research aims to observe and analyse legal problems in the effort to cover up the countries loss due to corruption practices. In fact, the existing criminal laws unable the police investigators to confiscate other assets owned by wrong ones to replace the countries monetary loss.This normative legal research uses the Statute Approach combined with the Case Approach. This research finding shows that the power of the Indonesian Police Investigators on confiscating assets from suspects that commit corruption is based on the formal requirements as stipulated in the Criminal Procedure Code. It is defined in the Eradication of the fact of Corruption Law 1999 (IDN) that assets allowed to be confiscated is limited to assets related directly to the suspected criminal act. In this respects, confiscation of other assets owned by the suspect is not regulated. It is advisable therefore to amend the criminal law in order to facilitate Police Investigators to confiscate the “other” assets to replace the countries financial loss (value based system).
