Abstract

Kosmetika untuk sebagian besar wanita merupakan kebutuhan pelengkap yang sangat dibutuhkan. Produk kosmetika merupakan perkembangan dari industri obat-obatan yang diedarkan produsen dengan berbagai jenis, merek dan manfaat. Namun seringkali ditemukan bahan berbahaya dalam sebuah kosmetika seperti merkuri, rhodamin b, hidrokuinon dan asam retinoat, yang memberikan dampak kepada pemakai seperti muncul alergi, iritasi dan kanker kulit. Untuk itu, diperlukan perlindungan konsumen dari perdagangan kosmetika yang mengandung bahan berbahaya melalui rekonstruksi hukum perlindungan konsumen. Rumusan masalah yang diangkat dalam penelitian ini adalah 1) Bagaimana norma pengaturan hukum terhadap perlindungan konsumen terkait perdagangan kosmetika dalam perspektif peraturan perundang-undangan di Indonesia?; 2) Bagaimana implementasi perlindungan hukum terhadap konsumen dalam perdagangan kosmetika yang aman dari bahan berbahaya?; 3) Bagaimana rekonstruksi pengaturan yang ideal untuk melindungi konsumen dari perdagangan kosmetika yang mengandung bahan berbahaya? Dengan menggunakan metode penelitian hukum normatif yang didukung oleh penelitian hukum empiris diketahui bahwa: 1) Norma/pengaturan hukum terhadap perlindungan konsumen terkait perdagangan kosmetika dalam perspektif peraturan perundang-undangan di Indonesia belum cukup memadai untuk memberikan perlindungan hukum kepada konsumen agar terhindar dari kosmetika yang mengandung bahan berbahaya. Regulasi yang ada lebih mengatur kepada persyaratan dalam produksi namun belum mengatur mengenai perdagangan kosmetika beserta pengawasannya secara memadai; 2) Implementasi perlindungan hukum terhadap konsumen dalam perdagangan kosmetika yang aman dari bahan berbahaya belum sepenuhnya terlaksana dengan baik; 3) Rekonstruksi pengaturan yang ideal untuk melindungi konsumen dari perdagangan kosmetika yang mengandung bahan berbahaya dipandang perlu untuk segera diwujudkan dengan memperbaiki ketentuan yang mengatur tentang Undang-Undang Perlindungan Konsumen, diantaranya hak konsumen; kewajiban pelaku usaha; moda penyelesaian sengketa konsumen; dan kelembagaan perlindungan konsumen. / Cosmetics for most women are a much-needed complementary need. Cosmetic products are the development of the drug industry that is circulatedby manufacturers with various types, brands and benefits. But often found harmful substances in a cosmetic such as mercury, rhodamine b, hydroquinone and retinoic acid, which have an impact on users such as allergies, irritation and skin cancer. For this reason, consumer protection from the trade of cosmetics containing hazardous ingredients is needed through the reconstruction of consumer protection laws. The formulation of the problem raised in this study is 1) What are the norms of legal regulation on consumer protection related to cosmetics trade in the perspective of laws and regulations in Indonesia?; 2) How is the implementation of legal protection for consumers in the trade of cosmetics that are safe from hazardous ingredients? ; 3) How to reconstruct the ideal arrangement to protect consumers from the trade in cosmetics containing harmful ingredients? By using normative research methods supported by empirical legal research, it is known that: 1) Legal norms/regulations on consumer protection related to cosmetics trade in the perspective of laws and regulations in Indonesia has not been able to provide enough legal protection to consumers to avoid cosmetics that contain harmful ingredients. Existing regulations regulate the requirements in production but have not regulated the trade in cosmetics and its supervision adequately; 2) The implementation of legal protection for consumers in the trade of cosmetics that are safe from hazardous ingredients has not been fully implemented properly; 3) Reconstruction of ideal arrangements to protect consumers from trade in cosmetics containing hazardous ingredients is considered necessary to be realized immediately by improving the provisions governing the Consumer Protection Law, including consumer rights; obligations of business actors; consumer dispute resolution modes; and consumer protection institutions.
