Abstract

Tesis ini membahas mengenai status kepemilikan Hak Cipta antara karyawan dan perusahaan berdasarkan doktrin kerja berdasarkan pesanan dan/atau “Work Made For Hire” yang ditinjau dari Undang-Undang Hak Cipta No.28 Tahun 2014 (“UUHC”) dan US Copyright Act 1976. Apakah sebuah ciptaan yang Pencipta hasilkan berdasarkan pesanan orang lain, hak ciptanya tetap berada di Pencipta atau orang yang memesan karya tersebut. Lalu bagaimana jika Pencipta menciptakan suatu karya ketika ia sedang dalam ikatan hubungan kerja, berada di tangan siapakah hak cipta atas karya itu. Mengenai hubungan kerja, untuk terciptanya suatu hubungan kerja tentu terlebih dahulu terdapat perjanjian untuk melakukan hubungan kerja.Berdasarkan UUHC Indonesia Pasal 36 menyatakan bahwa jika suatu ciptaan dibuat dalam hubungan kerja atau berdasarkan pesanan, pihak yang membuat karya cipta itu dianggap sebagai pencipta dan pemegang hak cipta, kecuali apabila diperjanjikan lain antara kedua pihak, sedangkan berdasarkan US Copyright Act Title 17 menyatakan bahwa karya cipta yang dibuat berdasarkan pesanan, perusahaan atau untuk siapa karya tersebut dibuat maka dianggap sebagai pemilik Hak Cipta kecuali diperjanjikan lain, antara Indonesia dan Amerika Serikat memiliki perbedaan atas kepemilikan Hak Cipta yang dibuat atas doktrin “Work Made For Hire”, tetapi terdapat pula persamaan antara keduanya, keduanya sama-sama dapat membuat kesepakatan bersama untuk kepemilikan Hak Cipta yang dapat dituangkan dalam perjanjian tertulis. Oleh karena itu, antara karyawan dan perusahaan sebetulnya dapat mengacu kepada perjanjian kerja masing-masing. / This thesis discusses the status of Copyright ownership between employees and companies based on the doctrine of "Work Made For Hire" in terms of the Copyright Law No. 28 of 2014 ("UUHC") and the US Copyright Act 1976. Whether a work the Creator produces is based on someone else's order, the Copyright remains with the Creator or the person who ordered the work. Then what if the Creator creates a work when he is in a working relationship? In whose hands is the Copyright to that work? Regarding work relations, to create a working relationship, of course, there must first be an agreement to carry out a work relationship. Based on UUHC Indonesia, Article 36 states that if a work is made in a working relationship or based on an order, the party making the copyrighted work is considered the creator and copyright holder unless otherwise agreed between the two parties. In contrast, based on the US Copyright Act Title 17 states that copyrighted works made for hire, the company or for whom the work was done is considered the owner of the Copyright unless otherwise agreed; between Indonesia and the United States, there is a difference in the ownership of Copyrights made based on the doctrine of "Work Made for Hire." However, there are also sales between the two; both can make a mutual agreement for copyright ownership which can be included in a written agreement. Therefore, employees and companies can refer to their respective work agreements.
