Abstract

Kontrak merupakan kesepakatan antara pengguna jasa dengan pihak penyedia jasa dalam melakukan transaksi berupa kesanggupan melaksanakan sesuatu dengan sejumlah uang sebagai imbalan yang terbentuk dari hasil negosiasi dan perundingan antara keduanya. Ketika para pihak telah melakukan kesepakatan kontrak, sering terjadi ketidaksesuaian dengan isi dari pada kontrak itu sendiri yang dapat mengakibatkan adanya kerugian material, waktu, dan biaya baik dari pihak penyedia jasa maupun pihak pengguna jasa, bahkan sampai pada pemutusan kontrak dan ke ranah hukum. Tujuan penelitian ini adalah untuk menganalisis risiko penggunaan kontrak lumsum dan kontrak waktu penugasan jasa konsultansi konstruksi ditinjau dari sisi biaya, mutu, dan waktu, serta tindakan mitigasi terhadap risiko yang ditimbulkan. Penelitian ini dilakukan dengan observasi, meneliti aturan yang berlaku, menganalisis kontrak, dan mengkaji analisis risiko masing-masing kontrak. Hal ini didapatkan melalui penyebaran kuesioner kepada responden berdasarkan variabel risiko dari hasil kajian dan validasi pakar. Hasil penelitian didapatkan bahwa dari empat belas (14) variabel risiko dari persepsi pengguna jasa terdapat empat (4) variabel dengan kategori rendah, tujuh (7) kategori sedang, dan tiga (3) kategori tinggi. Hasil dari persepsi penyedia jasa terdapat tiga (3) variabel dengan kategor rendah, tujuh (7) dengan kategori sedang, dan empat (4) dengan kategori tinggi. Variabel risiko yang berdampak sangat tinggi baik dari persepsi pengguna jasa maupun penyedia jasa konsultansi konstruksi didapatkan bahwa variabel keterlambatan waktu pelaksanaan pekerjaan disebabkan oleh faktor-faktor seperti perubahan ruang lingkup pekerjaan, kesulitan lapangan, cuaca buruk, dan keterbatasan sumber daya./The contract is an agreement between the service user and the service provider in conducting transactions in the form of the ability to do something with a certain amount of money in return which is formed from the results of negotiations and negotiations between the two. When the parties have entered into a contractual agreement, there is often a discrepancy with the contents of the contract itself which can result in material, time and cost losses for both the service provider and the service user, even reaching the termination of the contract and going to court. The purpose of this study was to analyze the risks of using a lump sum contract and the time contract for the assignment of construction consulting services in terms of cost, quality and time, as well as mitigation measures for the risks incurred. This research was conducted by observing, examining the applicable rules, analyzing contracts, and reviewing the risk analysis of each contract. This was obtained by distributing questionnaires to respondents based on the risk variable from the results of the review and expert validation. The results showed that of the fourteen (14) risk variables from service user perceptions, there were four (4) variables in the low category, seven (7) in the medium category, and three (3) in the high category. The results of the service provider's perception are three (3) variables in the low category, seven (7) in the medium category, and four (4) in the high category. Risk variables that have a very high impact both from the perception of service users and construction consulting service providers, it is found that the variable delay in the time of execution of the work is caused by factors such as changes in the scope of work, field difficulties, bad weather, and limited resources.
