Abstract

Peredaran magic mushroom semakin marak terjadi di Indonesia terutama di Bali, disebabkan oleh pengaruh jamur tersebut yang mengandung senyawa psikoaktif seperti psilosibina yang mempengaruhi fungsi psikologis pengguna yang banyak diminati oleh masyarakat. Akan tetapi, pada faktanya magic mushroom memiliki dampak negatif dengan tingkat risiko sindroma ketergantungan yang tinggi. Tugas akhir ini bertujuan untuk mengetahui kualifikasi dari perdagangan magic mushroom yang terjadi di Bali termasuk sebagai tindak pidana psikotropika jo narkotika sesuai dengan ketentuan dalam Undang – Undang Nomor 5 Tahun 1997 tentang Psikotropika jo Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Dari hasil analisis dalam tugas akhir ini menunjukkan bahwa magic mushroom tergolong sebagai psikotropika golongan I yang dialihkan ke narkotika golongan I menurut ketentuan Undang – Undang Nomor 35 Tahun 2009 tentang Narkotika. Sehingga, perdagangan magic mushroom merupakan tindak pidana psikotropika jo narkotika yang memerlukan penegakan hukum secara tegas untuk mencegah adanya perdagangan lebih lanjut dan menjaga masyarakat terhadap bahaya magic mushroom. / The circulation of magic mushrooms is increasingly prevalent in Indonesia, particularly in Bali. This surge is attributed to the influence of these mushrooms, which contain psychoactive compounds like psilocybin, affecting users psychological functions. These mushrooms are highly sought after by the public. However, in reality, magic mushrooms have negative consequences, including a high risk of dependency syndrome. The purpose of this final project is to determine the classification of magic mushroom trade in Bali, specifically whether it falls under the category of tindak pidana psikotropika jo narkotika, as outlined in Undang – Undang Nomor 5 Tahun 1997 tentang Psikotropika jo Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. The analysis conducted in this final project reveals that magic mushrooms are classified as Psikotropika golongan I, which have been reclassified as Narkotika golongan I according to the provisions of Undang – Undang Nomor 35 Tahun 2009 tentang Narkotika. Consequently, trading in magic mushrooms constitutes a psychotropic and narcotic offense, necessitating strict law enforcement to prevent further trade and safeguard society from the dangers associated with magic mushrooms.
