Abstract

Industri perasuransian telah menjelma sebagai salah satu pilar utama perekonomian modern dewasa ini. Peranan sektor perasuransian kian signifikan seiring dengan arus globalisasi dan liberalisasi perdagangan, akselarasi inovasi teknologi dan proses difusinya, serta deregulasi berbagai sektor finansial dan pasar aktual. Asuransi juga sudah menjadi elemen utama dalam strategi manajemen risiko dan kompleksitas bagi individu, kelompok sosial, maupun kalangan bisnis. Asuransi berperan penting dalam upaya individu dan kelompok menghadapi dan menangani kondisi hidup yang semakin kompleks dan serba tidak pasti, tidak pelak lagi industri perasuransian merupakan salah satu industri terbesar di dunia dengan tingkat interdependensi yang sangat besar dengan industri-industri lain. Sarana investasi yang paling populer untuk menyiapkan dana investasi adalah asuransi. Pasal 1 Undang-Undang Nomor 40 Tahun 2014 tentang Usaha Perasuransian juncto Pasal 246 KUHD yang unsur-unsurnya meliputi pembayaran premi dari tertanggung, penggantian kerugian dari penanggung, dan adanya peristiwa yang belum tentu terjadinya serta didukung oleh Peraturan Otoritas Jasa Keuangan Nomor 23 /POJK.05/2015 Tentang Produk Asuransi Dan Pemasaran Produk Asuransi. Untuk mengetahui sejauh mana hak Yuridis Klausula Free Look Period Dalam Perjanjian Asuransi Kesehatan terhadap masyarakat atau pemegang polis, diperlukan penilitian dengan menggunakan metode yuridis normatif dengan pendekatan empiris tentang penerapan free look Period. Dalam penelitian ini melihat dari kenyataan atau data yang ada dalam praktik yang selanjutnya dihubungkan dengan ketentuan hukum yang berlaku dan juga pendekatan kasus, yaitu dengan medote wawancara langsung kepada pemegang polis asuransi tentang informasi free look period. Dari penelitian tersebut dapat disimpulkan apakah hak nasabah atau pemegang polis tentang informasi free look period disampaikan sesuai dengan peraturan tentang perasuransian. / The insurance industry has emerged as one of the main pillars of today's modern economy. The role of the insurance sector is increasingly significant along with the flow of globalization and trade liberalization, acceleration of technological innovation and its diffusion process, and the deregulation of various financial sectors and actual markets. Insurance has also become a major element in risk management strategies and complexity for individuals, social groups, and businesses. Insurance plays an important role in the efforts of individuals and groups to face and handle living conditions that are increasingly complex and completely uncertain, no doubt the insurance industry is one of the largest industries in the world with a very large degree of interdependence with other industries. The most popular investment tool for setting up investment funds is insurance. Article 1 Constitution Nomber 40 / 2014 concering insurance business. Article 246 KUHD whose elements include payment of premiums from the insured, compensation from the guarantor, and the occurrence of events that do not necessarily occur and are supported by the Financial Services Authority Regulation Number 23 /POJK.05/2015 Concerning Insurance Products and Insurance Product Marketing. To find out the extent of the juridical rights of the Free Look Period Clause in the Health Insurance Agreement for the public or policy holders, a research is needed using a normative juridical method with an empirical approach regarding the implementation of the free look Period. In this study, looking at the facts or data in practice which is then connected with applicable legal provisions and case approaches, namely by interviewing direct insurance policy holders about free look period information. From this research it can be concluded whether the rights of the customer or policyholder regarding the free look period information are conveyed in accordance with the regulations on insurance
