Abstract

Globalisasi telah menjadi pendorong lahirnya era perkembangan teknologi internet yang memberi dampak pada masyarakat dunia. Indonesia juga mengalami dampak tersebut. Dengan meningkatnya pemanfaatan teknologi internet juga melahirkan tantangan baru yaitu meningkatnya kejahatan penipuan online dalam perdagangan elektronik (electronic commerce/e-commerce) yang termasuk sebagai cyber crime. Masyarakat Indonesia sudah banyak yang telah menjadi korban dari tangan-tangan kriminal tersebut. Persoalan yang timbul adalah terkait pengaturan mengenai e-commerce dan pelaksanaan perlindungan hukum terhadap masyarakat dalam menghadapi tindakan kejahatan penipuan secara online di Indonesia. Metode penelitian dalam tesis ini adalah penelitian hukum normatif (normative legal research). Berdasarkan hasil analisa, penelitian ini menghasilkan 2 (dua) pokok kesimpulan, sebagai berikut: pertama, terdapat undang-undang yang telah mengatur dan saling mendukung mengenai e-commerce namun masih bersifat umum dan luas sehingga sudah saatnya pemerintah membuat undang-undang e-commerce dan kedua, aparat penegak hukum sebaiknya menggunakan Pasal 28 ayat (1) dan Pasal 45A ayat (1) UU ITE terhadap pelaku tindak penipuan online pada e-commerce karena ancaman pidana dan dendanya yang lebih berat daripada menggunakan Pasal 378 KUHP. Terhadap kesimpulan itu, disampaikan 2 (dua) rekomendasi, sebagai berikut: pertama, pemerintah sebaiknya membuat juga undang-undang tentang ketahanan dan keamanan e-commerce dan kedua, menyiapkan aparat penegak hukum yang menguasai teknologi dan juga menyediakan sarana dan prasarana pendukung di seluruh Indonesia agar setiap penipuan online dapat diselesaikan. / Globalization has become the driving force of emerse of internet technology era that create an impact on the world community, including Indonesia. The intensive utilization of internet technology bring up new challenges, such as increasing online fraud in electronic commerce (e-commerce) so called cyber crime. Indonesian people have been a victim of the hand of criminal actions. In this respect, the problem arise related to regulation of electronic commerce (e-commerce), particularly on the legal protection against online fraud in Indonesia. To analyse this problem, writer use normative legal research. The results of the analysis, conclude 2 (two) things as follows: first, the prevailing have been set based on several regulations and support each others. It needs, therefore, a single and comprehensive regulation on this e-commerce subject, secondly, law enforcement officers should use Article 28 paragraph (1) and Article 45A, paragraph (1) of the ITE LAW against the perpetrators of the crime online fraud in e-commerce because of the threat of criminal penalties more severe than the use of Article 378 of the Criminal Code. Considering those conclusion it is advisable for the government to set up legislation concerning the resilience and security (e-commerce) and to prepare human resources as well as the fasilities to capture crime of online fraud.
