Abstract

Anak merupakan makhluk sosial yang masih tergolong lemah dan sangat memerlukan perlindungan hukum. Segala sesuatu yang menyangkut ketentuan anak, baik itu aturan, hak, atau pun kewajiban, telah dicantumkan dalam peraturan perundang-undangan. Salah satu undang-undang yang memprioritaskan mengenai anak, yaitu Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak (secara bersama-sama disebut UU Perlindungan Anak). Namun, masih ada kasus yang melibatkan anak sebagai korban, yang tidak memprioritaskan UU Perlindungan Anak sebagai ketentuan untuk mensejahterakan hak anak. Tugas akhir ini memiliki tujuan untuk memberikan pengertian dan pemahaman terkait ketentuan hukum yang tepat bagi korban anak dan betapa pentingnya untuk mengutamakan UU Perlindungan Anak dalam hal mensejahterakan hak anak sesuai dengan konsiderans a, b, dan c UU Perlindungan Anak, daripada mengutamakan undang-undang lainnya, terutama dalam topik penelitian ini yang dikaitkan adalah Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga (selanjutnya disebut UU PKDRT) terhadap kasus penganiayaan oleh seorang ibu yang mengakibatkan kematian bagi anak. / Children are social creatures who are still relatively weak and really need legal protection. Everything that concerns the provisions of children, be it rules, rights, or obligations, has been included in the laws and regulations. One of the laws that prioritizes children is Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection (collectively referred to as the Child Protection Law). However, there are still cases involving children as victims, who do not prioritize the Child Protection Law as a provision for the welfare of children's rights. This final project aims to provide understanding and understanding regarding the appropriate legal provisions for child victims and how important it is to prioritize the Child Protection Law in terms of prospering children's rights in accordance with considerations a, b, and c of the Child Protection Law, rather than prioritizing other laws, especially in this research topic which is related to Law Number 23 of 2004 concerning the Elimination of Domestic Violence (hereinafter referred to as the Law on Domestic Violence) against cases of maltreatment by a mother resulting in death for the child.
