Abstract

Berbagai bencana alam yang terjadi di Indonesia yang mengakibatkan dampak besar bagi masyarakat yang terdampak. namun penanganan korban bencana alam yang kurang maksimal sering kali menjadi faktor penyebab semakin parahnya keadaan korban. Salah satu kasus yang penulis berikan adalah bencana alam yang terjadi di Palu, Sulawesi Tengah yang dimana pemerintah lambat menangani pemberian bantuan logistik maupun bantuan tunai berupa uang santunan. Hukum Negara dan BPBD Kota Palu seharusnya menjadi pelindung dan kesiapsiagaan dala penanggulangan bencana alam dan pemberian bantuan secara menyeluruh kepada masyarakat terdampak. Menurut penulis dalam pemberian bantuan dalam bencana alam masih melanggar pasal 2 UU Penanggulangan bencana dan Pasal 9, Pasal 35 dan Pasal 71 UU HAM. Dengan membahas permasalahan apakah pemberian bantuan dari pemerintah pada warga negara yang terdampak bencana alam di Palu Sulawesi Tengah sudah sesuai dengan aturan hukum yang ada. Hal ini untuk mengetahui apakah sudah sesuai pemberian bantuan berupa uang tunai yang diterima korban bencana alam di Palu Sulawesi Tengah. Penelitian ini penulis menggunakan pendekatan Statue Approach yang memiliki arti pendeketan menggunakan perundang-undangan yang berlaku di Indonesia dan Conceptual Approach yaitu pendeketan secara konseptual. Pembahasan terkait dengan judul “ Tanggung Jawab Negara Terhadap Warga Negara Yang Terdampak Gempa Bumi, Tsunami, dan Likuifaksi ( Kasus di Palu Sulawesi Tengah) / State responsibility towards citizens affected by earthquakes, tsunamis and liquefaction (case in Palu, Central Sulawesi) Various natural disasters occurred in Indonesia which had a major impact on the affected communities. However, less than optimal handling of natural disaster victims is often a factor that causes the victims' condition to worsen. One of the cases that the author provides is the natural disaster that occurred in Palu, Central Sulawesi, where the government was slow to handle the provision of logistical assistance and cash assistance in the form of compensation money. State law and Palu City BPBD should be protective and prepared in dealing with natural disasters and providing comprehensive assistance to affected communities. According to the author, providing assistance in natural disasters still violates Article 2 of the Disaster Management Law and Article 9, Article 35 and Article 71 of the Human Rights Law. By discussing the issue of whether the provision of assistance from the government to citizens affected by natural disasters in Palu, Central Sulawesi is in accordance with existing legal regulations. This is to find out whether it is appropriate to provide assistance in the form of cash received by victims of natural disasters in Palu, Central Sulawesi. In this research, the author uses the Statue Approach, which means an approach using the legislation in force in Indonesia and the Conceptual Approach, namely a conceptual approach. The discussion is related to the title "State Responsibility towards Citizens Affected by the Earthquake, Tsunami and Liquefaction (Case in Palu, Central Sulawesi)
