Abstract

Adat Petekan yang ada di desa Ngadas Kabupaten malang adalah adat mengenai tes keperawanan bagi setiap wanita yang ada disana, apabila kedapatan wanita yang hamil atau tidak perawan lagi akan mendapat sanksi sosial. Sementara dalam UU No. 39 Tahun 1999mengenai Hak Asasi Manusia dalam bagian tentang hak wanita di situ sangat jelas di atur tentang hak mengenai wanita dan alat reproduksinya. Rumusan masalah yang penulis bahas dalam skripsi ini ialah Apakah tradisi “Petekan” dapat dikatakan sebagai pelanggaran terhadap Hak Asasi Manusia? Metodologi yang di gunakan dalam penelitian ini adalah metode yuridis normatif yang selanjutnya akan mengunakan penelitian dengan menelaah Undang Undang No.39 Tahun 1999 tentang Hak Asasi Manusia dan mempelajari tentang pendapat beberapa ahli Hukum / Adat Petekan in Ngadas village, Malang Regency is customary about a virginity test for every woman there, the debate finds that women who are pregnant or not virgins will receive social sanctions. While in Law No. 39 of 1999 concerning Human Rights in the section on women's rights there is very clearly regulated about the rights about women and their reproductive organs. The formulation of the problem that the author discusses in this thesis is "Petekan" can be questioned as against Human Rights? The methodology used in this study is a normative juridical method which will further use research by examining Law No.39 of 1999 concerning Human Rights and research on the opinions of several Legal experts
