Abstract

Perkembangan teknologi berkembang begitu pesat terutama dibidang teknologi informasi dan Artificial Intellegence (kecerdasan buatan) sehingga terciptanya Robot Humanoid. Dengan kehadiran Robot Humanoid dapat menggantikan fungsi manusia dalam melakukan pekerjaan-pekerjaan yang selama ini hanya dapat dilakukan oleh manusia alamiah. Contoh pekerjan-pekerjaan yang dapat dilakukan oleh Robot Humanoid, antara lain: customer service, resepsionis, sales service, purchasing service dan masih banyak hal lagi yang dapat dilakukan. Dengan kecerdasan yang dimiliki oleh Robot Humanoid dapat dimungkinkan juga menjadi pengurus dari suatu badan hukum yang mewakili badan hukum tersebut dalam melakukan perbuatan hukum. Dalam kepengurusan badan hukum (legal entity) dikenal kepelakuan fungsional (fungsional daderschap) . Dalam kepelakuan fungsional (fungsional daderschap) berbicara tentang perbuatan fungsional, pertanggungjawaban fungsional dan sanksi pidana fungsional. Dalam kepelakuan fungsional perbuatan hukum oleh Robot Humanoid diidentikkan sebagai perbuatan korporasi, dimana Robot Humanoid tersebut dikendalikan oleh programmer. Dan asas-asas yang mendasari pertanggungjawaban fungsional tersebut, yakni: strict liability, vicarious liability, identification, delegation dan respondeat superior. Dalam hukum pidana yang berbicara mengenai deelneming (keturutsertaan), manusia programmer sebagai manus domina (pelaku intelektual) dan Robot Humanoid sebagai manus ministra. Dalam teori tentang alat (de leer van het instruments), Robot Humanoid hanya dianggap sebagai alat. / Technological developments develop so rapidly especially in the field of information technology and Artificial Intellegence so the creation of Humanoid Robot. With the presence of Humanoid Robot can replace the human function in doing jobs that had been only natural man can do. Examples of work that can be done by Humanoid Robot, among others: customer service, receptionist, sales service, purchasing service and many more things that can be done. With the intelligence possessed by the Humanoid Robot may also be a board of a legal entity that represents the legal entity in performing legal acts. In the stewardship of legal entity (legal entity) known functional daderschap. In functional daderschap talk about functional actions, functional responsibilities and functional criminal sanctions. In the functional functionality of legal action by Humanoid Robot is identified as a corporate act, where Humanoid Robot is controlled by the programmer. And the underlying principles of functional responsibility are: strict liability, vicarious liability, identification, delegation and respondeat superior. In the criminal law which speaks of deelneming, human programmer as manus domina (intellectual actor) and Humanoid Robot as manus ministra.
