Abstract

Korupsi adalah tindakan pejabat publik, baik politisi maupun pegawai negeri, serta pihak lain yang terlibat dalam tindakan itu yang secara tida wajar menyalahgunakan kepercayaan publik yang dikuasakan kepada mereka untuk mendapatkan keuntungan sepihak. Suap merupakan tindakan memberian uang, barang atau bentuk lain dari pembalasan dari pemberi suap kepada penerima suap yang dilakukan untuk mengubah sikap penerima atas kepentingan/minat si pemberi, walaupun sikap tersebut berlawanan dengan penerima. Suap kadang berkaitan dengan gratifikasi. Gratifikasi yang merupakan tindak pidana korupsi baru yang sedang marak terjadi di kalangan pejabat atau penyelenggara negara. Gratifikasi adalah pemberian hadiah. Hadiah yang dimaksud bisa berupa barang, uang, discount, dan fasilitas lainnya. Terdapat juga gratifikasi berupa jasa pelayanan wanita dimana seorang pejabat menerima hadiah berupa jasa pelayanan wanita yang kemudian jasa termasuk masuk dalam kategori “fasilitas lainnya”. Walaupun pembuktian untuk gratifikasi jasa pelayanan wanita ini masih sulit dibuktikan, tapi tindak pidana gratifikasi tersebut tidak boleh diabaikan. / Corruption is a form of dishonesty undertken by a person entrusted with a position of authority, often to acquire personal benefit. Bribery is the act of giving money, goods or other forms of retaliation from the bribe to the bribe recipients made to change the recepients attitudes to the giver’s interests, even though the attitude is contrary to the recipient. Bribes sometimes relate to gratuities. Gratification which is a new corruption crime is rife among officials. Gratuities are a gift. The prizes can be in the form of goods, money, discount, and other facilities. There is also a gratuity in the form of a woman service where an official receives a prize in the form of a woman service which then includes services included in the category of "other facilities". Although the proof of gratuities for women services is still difficult to prove, the gratification cant be ignored.
