Abstract

Notaris dituntut untuk dapat mengetahui tanggung jawab dan wewenang notaris dalam menjalankan jabatannya sesuai dengan Undang-Undang Jabatan Notaris. Salah satunya adalah kewenangan Notaris di Undang-Undang Nomor 30 Tahun 2004 jo Undang�Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris. Pasal 15 ayat 2 huruf b “Notaris juga berwenang: membukukan surat di bawah tangan dengan mendaftar dalam buku khusus”. Tetapi sekarang ini Waarmerking telah menjadi celah bagi seorang Notaris untuk dapat bersalah. Tujuan penelitian ini adalah untuk mengetahui tanggung jawab Notaris dalam melakukan pendaftaran perjanjian PPJB yang dibuat oleh pelaku pembangunan dan pembeli dengan metode pre project selling yang obyeknya belum ada, serta perlindungan hukumnya bagi pembeli. Jenis penelitian dilakukan dengan menggunakan metode penelitian normatif empiris dan menggunakan pendekatan kasus, perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa tanggung jawab notaris dalam waarmerking hanya sebatas pada membenarkan bahwa para pihak membuat perjanjian pada tanggal yang tercantum dalam dokumen yang didaftarkan dalam buku khusus, akan tetapi tanggung jawab moril notaris kurang dikedepankan, sedangkan dalam Undang-Undang Rumah Susun dan Undang-Undang Cipta Kerja tidak mengatur tanggung jawab moril notaris pada Perjanjian Pengikatan Jual Beli Pre Project Selling dan akibat hukum dari perjanjian yang dibuat dengan tidak memenuhi syarat yang telah ditetapkan Undang-Undang Rumah Susun, dengan sistem pre project selling yang obyeknya belum ada, perjanjian tersebut bisa batal demi hukum. Perlindungan hukum terhadap pembeli yang merasa dirugikan dapat menggugat pihak pelaku pembangunan ke lembaga pengadilan agar mendapatkan perlindungan hukum. / Notaries are required to be able to know the responsibilities and authorities of notaries in carrying out their positions in accordance with the Notary Position Law. One of them is the authority of Notaries in Law Number 30 of 2004 jo Law Number 2 of 2014 concerning Notary Positions. Article 15 paragraph 2 letter b "Notaries are also authorized: to book letters under hand by registering in a special book". But now Waarmerking has become a loophole for a Notary to be guilty. The purpose of this study is to determine the Notary's responsibility in registering PPJB agreements made by development actors and buyers with the pre-project selling method whose objects do not yet exist, as well as legal protection for buyers. This type of research is carried out using empirical normative research methods and using case, legislative and conceptual approaches. The results showed that the notary's responsibility in waarmerking is limited only to justifying that the parties make an agreement on the date stated in the document registered in the special book, however the moral of responsibilities of notaries are not prioritized, whereas the Flats Law and Omnibus Law on Job Creation do not regulate the moral responsibilities of notaries in Pre Project Selling agreements, and the legal consequences of an agreement made by not meeting the conditions stipulated by the Flats Law, with a pre-project selling method whose object does not yet exist, the agreement can be null and void. Legal protection for buyers who feel aggrieved can sue the development actors to the court institution to get legal protection.
