Abstract

Penelitian ini membahas mengenai perlindungan hukum bagi konsumen terhadap penyedia jasa layanan transportasi umum. Seperti diketahui bahwa di Indonesia banyak terjadi kecelakaan yang disebabkan oleh tidak terpenuhinya standar minimum transportasi sesuai dengan ketentuan dalam perundang￾undangan. Mengacu pada studi kasus kecelakaan Perusahaan Otobus (PO) Sumber Kencono yang berakibat pada dirugikannya hak-hak konsumen,.dalam penelitian ini akan dibahas mengenai hak-hak konsumen yang tidak terpenuhi terkait dengan standar minimum transportasi. Penelitian ini menggunakan metode penelitian yuridis normatif dimana pengolahan bahan hukum sebagaian besar dilakukan secara studi pustaka. Dari hasil penelitian, dapat diambil kesimpulan bahwa dalam kasus kecelakaan terdapat beberapa hak yang tidak dipenuhi oleh Perusahaan Otobus (PO) Sumber Kencono yaitu dari aspek keselamatan berupa tidak terpenuhinya standar guna operasi, aspek keamanan dan kenyamanan berupa tidak terpenuhinya standar tentang kapasitas daya angkut penumpang. Dengan demikian, adapun saran yang dapat dilakukan adalah dengan melakukan sosialisasi permenhub kepada masyarakat dan pelatihan terhadap tenaga pengemudi. / This study focus on the legal protection for consumers on public transport services, as we know in Indonesia many accidents are caused by non-fulfillment of the minimum standard of transportation in accordance with law and regulations. Refer to the case study on accident by otobus company Sumber Kencono, this research will discuss about the rights of consumers are not run the minimum standard of transportation . This study using Legal-Normative method where the legal materials mostly by processing in literature. From the results, it can be concluded that there are some rights are not fulfilled by the otobus company Sumber Kencono from the aspect of safety and security. Thus, as for proportion that government can be socializiation to the public about minister regulation and training to personnel driver.
