Abstract

Pelek mobil berbahan aluminium merupakan produk yang desainnya dilindungin oleh undang-undang No. 31/2000 tentang Desain Industri dan merek dagangnya dilindungin oleh undang-undang No. 15/2001 tentang Merek. Desain dari pelek unik dan membutuhkan usaha serta proses kreatifitas untuk penciptaanya yang mengandung nilai ekonomis sehingga perlu dilindungin hak desainnya oleh undang-undang. Sedangkan merek pada produk pelek aluminium memiliki peranan penting sebagai penunjuk awal jaminan mutu produk tersebut. Oleh karena itu perlindungan terhadap hak merek tersebut sangat penting dikarenakan produk pelek aluminium dipasang di mobil yang dijalankan pada kecepatan tinggi. Produk dengan merek tiruan yang seringkali memiliki standar mutu dibawah merek asli akan sangat membahayakan pengguna apabila dipasang di mobil. Meskipun pada produk pelek mobil berbahan aluminium terkandung unsur teknologi dalam proses pembuatannya yang secara hukum dilindungin oleh undang-undang perlindungan paten di Indonesia, Tesis ini hanya membahas dari sudut desain dan mereknya dikarenakan tidak mudah untuk melakukan pembahasan dan perbandingan paten yang sangat dirahasiakan oleh perusahaan produsen pelek aluminium. Pembahasan terhadap hakikat dari desain industri, unsur�unsurnya menurut undang-undang No. 31/2000 tentang Desain Industri dan analisis terhadap khususnya perlindungan hukum hak atas desain industri menurut undang-undang No. 31/2000 tentang Desain Industri terhadap produk pelek aluminium.Tesis ini juga membahas hakikat dari merek, prinsip-prinsip perlindungan merek menurut undang-undang No. 15/2001 tentang Merek dan analisis perlindungan hukum hak atas Merek menurut undang-undang No. 15/2001 tentang Merek terhadap produk pelek aluminium. / Alloy wheels’s design is protected under Industrial Design Law No. 31/2000 and its trade mark is also protected under Trade Mark Law No. 15/2001. Wheel’s design is unique and its creation need efforts that has economic value thus the design right need to be protected by law. The trade-mark of wheel itself has important position as the first indicator of quality of the wheels. Counterfeit or imitation trade-mark of Alloy wheel product often has safety and quality standard that far below the original product, so when they installed on the car, it may jeopardizes the customers who use those wheels. Therefore the protection of trade-mark is very important because wheel will be installed on the car that run on very high speed. This thesis discusses the nature of industrial design, its elements according to Industrial Design Law No. 31/2000 and analysis of the protection of alloy wheel according that law. This thesis also discusses the nature of trade-mark, the principles of trade-mark protection under Trade-mark Law No. 15/2001 and analysis of trade-mark protection of alloy wheels under Trade-mark Law No. 15/2001.
