Abstract

Dalam praktiknya, peralihan hak atas tanah dapat dilaksanakan oleh Pejabat Pembuat Akta Tanah (PPAT) melalui Akta Jual Beli (AJB) berdasarkan Perjanjian Pengikatan Jual Beli (PPJB) yang dibuat oleh Notaris, setelah semua persyaratan untuk melaksanakan jual beli telah dipenuhi para pihak. Seperti dalam kasus penelitian ini, PPAT telah membuat AJB berdasarkan PPJB, namun PPJB tersebut mengandung cacat hukum, yang terdapat pada bagian komparisi dan Pasal 7 PPJB mengenai pemberian kuasa kepada staffnya, sehingga mengakibatkan pihak penjual dirugikan atas peralihan hak atas tanah yang telah dilakukan oleh Notaris/PPAT. Dalam penelitian tesis ini membahas mengenai bagaimana peran Notaris dan PPAT dalam peralihan hak atas tanah dan bagaimana pertanggungjawaban Notaris dan PPAT terhadap aktanya yang dibatalkan oleh Pengadilan dengan menggunakan Studi Kasus Putusan Mahkamah Agung Nomor 1572 K/PDT/2023. Jenis penelitian ini menggunakan penelitian hukum normatif dengan jenis data sekunder yang diperoleh dari studi kepustakaan yang kemudian dianalisis secara kualitatif. Hasil penelitian ini yaitu Pasal pemberian kuasa dalam PPJB yang dibuat Notaris hanya dapat diberikan kepada Pembeli bukan pihak lain sebagai dasar penandatanganan AJB di hadapan PPAT. Notaris/PPAT memiliki pertanggungjawaban baik secara perdata, administratif, bahkan secara pidana apabila terbukti bahwa Notaris/PPAT telah melakukan pelanggaran dalam melaksanakan jabatan sehingga menimbulkan kerugian kepada pihak lain. / In practice, the transfer of land rights can be carried out by a Land Deed Official (PPAT) through a Sale and Purchase Deed (AJB) based on a Sale and Purchase Bonding Agreement (PPJB) made by a Notary, after all the requirements to carry out the sale and purchase have been fulfilled by the parties. As in the case of this research, the PPAT has made an AJB based on the PPJB, but the PPJB contains legal defects, which are found in the comparison section and Article 7 of the PPJB regarding the granting of power to its staff, resulting in the seller being disadvantaged by the transfer of land rights that has been carried out by the Notary/PPAT. This thesis research discusses how the role of Notaries and PPATs in the transfer of land rights and how the liability of Notaries and PPATs for deeds canceled by the Court using the Case Study of the Supreme Court Decision Number 1572 K/PDT/2023. This type of research uses normative legal research with secondary data obtained from literature studies which are then analyzed qualitatively. The results of this study are that the article on granting power of attorney in the PPJB made by the Notary can only be given to the Buyer and not other parties as the basis for signing the AJB in front of the PPAT. Notary/PPAT has civil, administrative, and even criminal liability if it is proven that the Notary/PPAT has committed a violation in carrying out the position that causes losses to other parties.
