Abstract

Notaris adalah pejabat umum yang berwenang untuk membuat akta autentik dan kewenangan lainnya. Notaris merupakan pejabat umum dan satu-satunya yang berwenang dalam membuat akta autentik mengenai segala perbuatan, perjanjian dan penetapan yang diatur oleh yang berkepentingan menghendaki untuk dinyatakan dalam suatu akta autentik, serta menjamin kepastian tangalnya, menyimpan aktanya dan memberikan grosse akta, salinan akta dan kutipannya, semuanya sepanjang pembuatan akta itu tidak dikecualikan lain. Kewenangan notaris selain membuat akta autentik, notaris juga berwenang mengesahkan tanda tangan dan menentukan tanggal pasti surat-surat yang dimilikinya. Notaris dalam menjalankan jabatannya wajib untuk menyimpan minuta akta dan segala dokumen yang berkaitan dengan perbuatan hukum yang dilakukan para pihak sehubungan dengan pembuatan suatu akta. Protokol Notaris merupakan kumpulan surat-surat yang merupakan arsip negara dan wajib disimpan serta dipelihara oleh Notaris sesuai dengan ketentuan ketetapan Undang-Undang. Notaris bertanggung jawab atas protokol notarisnya sampai notaris tersebut pensiun. Tanggung jawab berakhir apabila notaris meninggal dunia. Penyerahan protokol notaris telah diatur dalam UUJN. Penerima protokol notaris tidak bertanggung jawab atas protokol yang diterimanya. Penerima protokol hanya memiliki tanggung jawab untuk menjaga dan memelihara protokol yang diserahkan kepadanya. / A notary is a public official who has the authority to make authentic deeds and other authorities. A notary is a public official and is the only one who has the authority to make authentic deeds regarding all deeds, agreements and stipulations regulated by those interested in wishing them to be stated in an authentic deed, as well as guaranteeing the certainty of the date, keeping the deed and providing grosse deeds, copies of deeds and quotations. , everything as long as the deed is made is not excluded otherwise. Apart from making authentic deeds, the notary also has the authority to certify signatures and determine the exact date of the documents he has. In carrying out his office, a notary is obliged to keep the minutes of the deed and all documents relating to legal actions carried out by the parties in connection with the making of a deed. The Notary Protocol is a collection of documents which constitute state archives and must be kept and maintained by the Notary in accordance with the provisions of the Law. The notary is responsible for his or her notarial protocol until the notary retires. Responsibility ends when the notary dies. Submission of notary protocols is regulated in the UUJN. The recipient of the notary protocol is not responsible for the protocol he receives. The protocol recipient only has the responsibility to safeguard and maintain the protocol submitted to him
