Abstract

Perkawinan merupakan suatu hubungan hukum ikatan yang sah antara pria dengan wanita yang telah memenuhi syarat-syarat sahnya suatu perkawinan. Pasal 35 Undang-Undang Nomor 1 Tahun 1974 tentang perkawinan menyatakan bahwa harta benda yang diperoleh selama ikatan perkawinan menjadi harta bersama. Jika ingin melakukan tindakan hukum terhadap harta tersebut harus dengan persetujuan kedua belah pihak. Jika terjadi perceraian bila harta bersama tersebut belum terbagi maka itu akan tetap menjadi harta bersama. Untuk proses jual beli harta bersama berupa tanah harus dibuat dihadapan pejabat yang berwenang yaitu Pejabat Pembuat Akta Tanah (PPAT). PPAT dalam menjalankan kewajibannya harus sesuai dengan peraturan perundang-undangan dan Kode Etik PPAT. Tesis ini membahas tentang tanggung jawab PPAT tehadap Akta Jual Beli (AJB) harta bersama yang belum terbagi tanpa persetujuan mantan istri. Metode dalam penelitian hukum ini adalah normatif empiris. Dari hasil penelitian, disimpulkan bahwa AJB terhadap harta bersama yang belum terbagi yang dibuat dihadapan PPAT tersebut tidak sah dan tidak mempunyai kekuatan hukum tetap. Terkait dengan tanggung jawab PPAT terhadap AJB tersebut dapat dikenakan pertanggungjawaban administratif dan pertanggungjawaban perdata. / Marriage is a legal relationship between a man and a woman who has fulfilled the legal requirements for a marriage. Article 35 of Law Number 1 of 1974 concerning marriage states that property obtained during the marriage bond becomes joint property. If you want to take legal action against the property, it must be with the consent of both parties. In the event of a divorce, if the joint property has not been divided, it will remain joint property. The process of buying and selling joint assets in the form of land must be made before an authorized official, namely the Land Deed Official (PPAT). In carrying out its obligations, PPAT must comply with statutory regulations and the PPAT Code of Ethics. This thesis discusses the PPAT's responsibility regarding the Deed of Sale and Purchase (AJB) of joint assets that have not been divided without the consent of the ex-wife. The method in this legal research is normative empirical. From the research results, it was concluded that the AJB for undivided joint assets made before the PPAT was invalid and had no permanent legal force. Regarding PPAT's responsibility towards AJB, it may be subject to administrative responsibility and civil liability.
