Abstract

Seiring terbatasnya lahan sebagai tempat untuk tinggal atau memiliki rumah, maka perusahaan pengembang mendirikan bangunan berupa rumah susun sebgai jawaban dari sulitnya memiliki rumah di perkotaan. Pendirian rumah susun dapat didirikan pada tanah Hak Milik maupun tanah Hak Guna Bangunan atas tanah negara atau Hak Guna Bangunan diatas Hak Pengelolaan. Dalam penelitian ini bertujuan untuk melakukan penelitian terhadap Apartment Mangga Dua Court yang berdiri diatas Hak Guna Bangunan diatas Hak Pengelolaan. Permasalahan yang peneliti angkat adalah kedudukan Hak Milik Satuan Rumah Susun yang berdiri diatas tanah Hak Guna Bangunan diatas Hak Pengelolaan serta kepastian hukum dalam rangka perpanjangan jangka waktu Hak Milik Satuan Rumah Susun yang berdiri diatas tanah Hak Guna Bangunan diatas Hak Pengelolaan. Jenis penelitian ini adalah yuridis normatif dengan melakukan pendekatan dengan kasus, undang-undang, konseptual dan analisis. Hasil dari penelitian yang peneliti lakukan adalah bahwa Hak Guna Bangunan dapat berdiri diatas tanah Hak Pengelolaan dengan melakukan perjanjian kerjasama pemanfaatan tanah dengan pihak ketiga. Salah satu pemanfaatannya adalah dengan mendirian Rumah Susun. Satuan Rumah Susun yang berdiri di atas Hak Pengelolaan dapat berdiri dengan jangka waktu 80 (delapan puluh) tahun dan 50 (lima puluh) tahun untuk Hak Guna Bangunan yang berdiri doatas tanah negara serta pemengan Hak Pengelolaan wajib memberikan persetujuan dalam rangka perpanjangan jangka waktu. Perpanjangan Hak Guna Bangunan dapat diberikan setelah mendapatkan Sertipikat Laik Fungsi. Bukti kepemilikan dari satuan rumah susun adalah dengan diterbitkannya Sertipikat Hk Milik Satuan Rumah Susun (SHMSRS). Satuan Rumah Susun dapat dijadikan sebagai jaminan utang dengan mendapatkan rekomendasi dari pemegang Hak Pengelolaan. / As land is limited as a place to live or own a house, development companies are building buildings in the form of flats as an answer to the difficulty of owning a house in urban areas. The construction of an apartment can be built on land with ownership rights or land with building use rights over state land or building use rights over management rights. This research aims to conduct research on the Mangga Dua Court Apartment which stands on building use rights above management rights. The problem that the researcher raises is the position of ownership rights for condominium units standing on land, building use rights over management rights, as well as legal certainty regarding the extension and/or term of ownership rights for condominium units standing on land, building use rights over management rights. This type of research is normative juridical by approaching it with cases, laws, conceptual and analysis. The results of the research conducted by researchers are that building use rights can be established on land management rights by entering into land use cooperation agreements with third parties. One use is to build flats. Condominium units standing on Management Rights can be established for a period of 80 (eighty) years and 50 (fifty) years for Building Use Rights standing on state land and holders of Management Rights are required to give approval for extension and/or renewal time period. Extension of Building Use Rights can be granted after obtaining a Certificate of Functional Appropriateness. Proof of ownership of an apartment unit is the issuance of a Certificate of Ownership of the Apartment Unit (SHMSRS). Flats can be used as collateral for debt by obtaining a recommendation from the Management Rights holder.
