Abstract
Problematika pertanahan terus mencuat dalam dinamika kehidupan berbangsa. Berbagai daerah di Indonesia memiliki karakteristik permasalahan pertanahan yang berbeda diantara satu wilayah dengan wilayah lainnya. Salah satunya yaitu permasalahan tanah yang terjadi di Manado tepatnya di kelurahan Malalayang Satu Timur. Berdasarkan Putusan Pengadilan Negeri Manado Nomor 406/PDT.G/ 2021/PN.MND, Merry M.P.Kuron sebagai tergugat yang memiliki bukti kepemilikan atas tanah berupa Sertipikat Hak Milik (SHM) dinyatakan kalah dari Regina Sambuaga sebagai penggugat yang memiliki catatan penarikan pajak berupa Letter C sehingga penelitian ini bertujuan untuk mendapatkan gambaran dan menganalisis mengenai penerbitan Sertipikat Hak Milik yang diperoleh pembeli berdasarkan jual beli atas tanah adat serta kedudukan hukum terhadap pembeli yang memperoleh Sertipikat Hak Milik berdasarkan jual beli atas tanah adat yang dilakukan dengan metode penelitian hukum normatif. Dari hasil penelitian tersebut dapat disimpulkan bahwa perlindungan hukum pada dasarnya telah diberikan kepada pembeli melalui pemberian Sertipikat yang diperoleh melalui proses pendaftaran tanah berdasarkan jual beli yang dilakukan antara nenek tergugat yaitu ratu kuron sebagai pembeli dengan David Kelung sebagai penjual dimana Sertipikat sebagai bukti kepemilikan yang sah atas tanah, bahkan berstatus Hak Milik yang merupakan hak turun-temurun, terkuat dan terpenuh yang dapat dipunyai orang atas tanah serta sifat-sifat dari hak milik membedakannya dengan hak-hak lainnya. Akibat Hukum jual beli atas tanah adat antara pembeli dengan penjual tetaplah sah karena sudah terpenuhinya seluruh syarat sahnya jual beli sehingga Putusan Pengadilan Negeri Manado dapat dikatakan tidaklah tepat. / Land problems continue to arise in the dynamics of national life. Various regions in Indonesia have different characteristics of land problems from one region to another. One of them is the land problem that occurred in Manado, precisely in the village of Malalayang Satu Timur. Based on Manado District Court Decision Number 406/PDT. G/2021/PN.MND, Merry M.P.Kuron as a defendant who has proof of ownership of land in the form of a Freehold Title was declared defeated by Regina Sambuaga as a plaintiff who has a record of tax withdrawal in the form of Letter C so that this study aims to obtain an overview and analyze the issuance of a Freehold Title obtained by buyers based on the sale and purchase of customary land and the legal position of buyers who obtain Freehold Title based on the sale and purchase of customary land carried out with normative legal research methods. From the results of the study, it can be concluded that legal protection has basically been given to the buyer through the provision of a Certificate obtained through the land registration process based on the sale and purchase carried out between the defendant's grandmother, Ratu Kuron as the buyer and David Kelung as the seller where the Certificate as proof of legal ownership of the land, even the status of Freehold which is a hereditary, strongest and fullest right that people can have over land and the nature of Right Of Ownership distinguishes it from other rights. Legal Effects of sale and purchase of customary land between buyer and seller remains valid because all legal conditions for buying and selling have been fulfilled so that the Manado District Court Decision can be said to be inappropriate.
