Abstract

Indonesia merupakan Negara yang memiliki sistem ketatanegaraannya berdasarkan asas hukum yang menggunakan sistem pembagian kekuasaan, supremasi hukum dan sistem pembagian kekuasaan. Penelitian ini merupakan penelitian hukum dengan metode penelitian yuridis empiris dengan melakukan studi kepustakaan. Perizinan berusaha jasa transportasi dilakukan melalui system OSS RBA yang diberikan kepada pelaku usaha yang dinilai berdasarkan tingkat resiko kegiatan usaha. Proses pengeluaran izin penyelenggaraan ini berdasarkan pada Peraturan Menteri nomor 117 Tahun 2018 pasal 36 ayat (1) dan (2). OSS telah menentukan klasifikasi baku lapangan usaha (KBLI) mengenai angkutan orang dengan kendaraan bermotor tidak dalam trayek. Ketidaksesuaian antara KBLI dalam akta perusahaan dengan implementasinya beradampak pada sejumlah aspek hukum, dampak yang ditimbulkan sejalan dengan teori manfaat hukum yang menyatakan bahwa suatu kemanfaatan hukum merupakan suatu hal yang utama untuk mencapai tujuan hukum itu sendiri. Saran dalam penelitian ini, secara teoritis penelitian selanjutnya harus mampu memjawab sejauh mana kewenangan hukum pemerintah dalam implementasi OSS-RBA mampu memberikan aspek keadilan dan kesejahteraan sebagaimana acuan teori negara kesejahteraan yang selama ini menjadi batu pijakan dalam penelitian-penelitian hukum tentang ekonomi, secara praktis kompleksitas penerapan KBLI sebagai acuan berusaha dan dalam memberikan perizinan seharusnya dapat ditinjau ulang sebagai bagian dari proses penyederhanaan investasi yang menjadi semangat dalam UU Cipta Kerja. / Indonesia is a country that has a constitutional system based on legal principles that uses a power-sharing system, the rule of law and a power-sharing system. This research is a legal research with empirical juridical research methods by conducting literature studies. Transportation services business licensing is carried out through the OSS RBA system which is given to business actors who are assessed based on the level of risk of business activities. The process of issuing this operating license is based on Ministerial Regulation number 117 of 2018 article 36 paragraph (1) and (2). OSS has determined the standard classification of business fields (KBLI) regarding transportation of people by motorized vehicles not on a route. The mismatch between KBLI in the company deed and its implementation has an impact on a number of legal aspects, the impact caused is in line with the theory of legal benefits which states that a legal benefit is the main thing to achieve the purpose of the law itself. The suggestions in this study, theoretically, further research must be able to answer the extent to which the government's legal authority in implementing OSS-RBA is able to provide aspects of justice and welfare as a reference to the welfare state theory which has been a stepping stone in legal research on economics, practically the complexity of applying KBLI as a reference for business and in providing licensing should be reviewed as part of the investment simplification process which is the spirit of the Job Creation Law.
