Abstract

Indonesia merupakan negara hukum sesuai yang diamanatkan oleh Pasal 1 ayat (3) Undang-Undang Dasar 1945 untuk menegakkan prinsip-prinsip negara hukum, yang melibatkan kepastian, ketertiban, dan perlindungan hukum. Namun, pertumbuhan sengketa di Indonesia terlihat dari peningkatan gugatan yang terus berdatangan ke pengadilan. Meski demikian, terdapat penyelesaian sengketa, baik di dalam maupun di luar pengadilan. Penyelesaian di luar pengadilan melibatkan proses perdamaian antara pihak-pihak yang berselisih, sesuai dengan budaya musyawarah dan kekeluargaan masyarakat Indonesia. Prinsip ini tercermin dalam upaya mencapai mufakat melalui musyawarah. Proses perdamaian ini diatur dalam hukum, khususnya Pasal 1851-1864 KUHPerdata, yang memberikan opsi ganti rugi kepada pihak yang dirugikan. Penyelesaian sengketa juga dapat dilakukan melalui Akta Perdamaian di hadapan Notaris. Notaris memiliki wewenang untuk menyusun Akta Perdamaian. Akta autentik yang dihasilkan Notaris menjadi bukti kuat terkait niat para pihak, menjadi pertimbangan hakim dalam persidangan. Penelitian ini merupakan analisis deskriptif mengenai kekuatan pembuktian Akta Perdamaian Notariil di Pengadilan, dengan pendekatan yuridis normatif yang terkait dengan Akta Perdamaian yang disusun di hadapan Notaris. Tujuan penelitian ini adalah memberikan penjelasan, gambaran, serta peningkatan pemahaman mengenai kekuatan pembuktian Akta Perdamaian Notariil di Pengadilan. Hasil penelitian menunjukkan bahwa Akta Perdamaian yang disusun di hadapan Notaris dapat menjadi opsi penyelesaian konflik antara pihak-pihak yang berselisih di luar pengadilan, dengan proses yang cepat dan lebih efektif. Disarankan kepada pihak-pihak yang terlibat konflik untuk mempertimbangkan penyelesaian damai melalui Notaris guna mencapai penyelesaian yang efektif dan efisien. / Indonesia is a legal state as mandated by Article 1 paragraph (3) of the 1945 Constitution, aiming to uphold the principles of a legal state, involving certainty, order, and legal protection. However, the growth of disputes in Indonesia is evident from the increasing number of lawsuits continually being filed in court. Nevertheless, there are dispute resolution options, both within and outside the court. Resolution outside the court involves a peace process between conflicting parties, in line with the Indonesian culture of deliberation and familial ties. This principle is reflected in efforts to achieve consensus through deliberation. The peace process is regulated by law, particularly Articles 1851-1864 of the Civil Code, providing compensation options for the aggrieved party. Dispute resolution can also occur through a Peace Deed before a Notary. Notaries have the authority to draft Peace Deeds. The authentic deeds produced by Notaries serve as strong evidence of the parties' intentions, considered by judges during trials. This study is a descriptive analysis of the probative strength of Notarial Peace Deeds in court, using a normative juridical approach related to Peace Deeds prepared before a Notary. The research aims to provide explanations, descriptions, and enhance understanding of the probative strength of Notarial Peace Deeds in court. The findings suggest that Peace Deeds prepared before a Notary can be an option for resolving conflicts between parties outside the court, with a faster and more effective process. It is recommended for parties involved in conflicts to consider peaceful resolution through a Notary to achieve efficient and effective solutions.
