Abstract

Akta jual beli adalah berkas otentik yang bisa menjadi bukti dari transaksi atau aktivitas jual beli maupun peralihan hak kepemilikan tanah, rumah, atau bangunan. Dalam kasus Putusan Mahkamah Agung Nomor Putusan 219 K/Pdt/2021 hakim mengadili bahwa AJB (Akta Jual Beli) dijadikan bukti kepemilikan sebidang tanah sengketa milik Tergugat, tanpa adanya bukti kepemilikan yang sah atas tanah yaitu sertifikat hak atas tanah. Penelitian ini untuk mengkaji kekuatan hukum AJB (Akta Jual Beli) yang dijadikan bukti milik sah sebidang tanah tanpa adanya sertifikat hak atas tanah. Metode penelitian yang digunakan adalah metode penelitian penelitian hukum normatif empiris yang bersifat Normatif didukung dengan wawancara Narasumber yaitu Dosen Hukum dengan jabatan Notaris&PPAT sebagai pihak narasumber dalam tesis ini. Dari hasil penelitian mendapatkan gambaran secara umum yang kesimpulannya adalah Akta Jual Beli merupakan perwujudan asas hukum adat yaitu terang dan tunai, sehingga jika Akta Jual Beli itu dibuat dan ditandatangani maka hak keperdataan itu sudah beralih, AJB (Akta Jual Beli) dalam kasus ini berdasarkan Putusan 219 K/Pdt/2021yang dijadikan dasar sebagai kepemilikan yang sah sebidang tanah sengketa merupakan suatu akta otentik yang memiliki kekuatan pembuktian yang kuat yaitu lahiriah, formal, materil, dan memiliki kekuatan pembuktian yang sempurna dan mengikat dibandingan Pemohon kasasi yang memiliki Surat Riwayat Kepemilikan Lahan Tahun 1996 yang dikeluarkan oleh kelurahan setempat. / A sale and purchase deed is an authentic file that can be proof of a transaction or buying and selling activity or the transfer of ownership rights to land, houses or buildings. In the case of Supreme Court Decision Number 219 K/Pdt/2021, the judge judged that the AJB (Deed of Sale and Purchase) was used as proof of ownership of a disputed plot of land belonging to the Defendant, without any proof of legal ownership of the land, namely a land title certificate. This research is to examine the legal strength of the AJB (Deed of Sale and Purchase) which is used as proof of legal ownership of a plot of land without a land title certificate. The research method used is an empirical normative legal research method that is normative in nature, supported by interviews with resource persons, namely Law Lecturers with the position of Notary & PPAT as the resource person in this thesis. From the research results, we get a general picture and the conclusion is that the Deed of Sale and Purchase is an embodiment of the principles of customary law, namely clear and cash, so that if the Deed of Sale and Purchase is made and signed then the civil rights have been transferred, AJB (Deed of Sale and Purchase) in this case is based on the Decision 219 K/Pdt/2021 which is used as the basis for legal ownership of a plot of disputed land is an authentic deed that has strong evidentiary power, namely external, formal, material, and has perfect and binding evidentiary power compared to the cassation applicant who has a land ownership history letter. 1996 issued by the local sub-district.
