Abstract

This thesis analyzes the role and responsibilities of a notary in creating legal certainty, particularly in the drafting of a business cooperation contract based on a case study titled "Analisis Peran dan Tanggung Jawab Notaris Dalam Menciptakan Kepastian Hukum dalam Kontrak Kerjasama Bisnis Berdasarkan Studi Kasus : Putusan Nomor 47/pdt.G/2020/PN Stb". In this thesis, real facts regarding the role and responsibilities of a notary in analyzing the case of putusan 47/pdt.G/2020/PN Stb, which involves a profit-sharing business cooperation, will be explored.The research methodology employed in this thesis is a normative juridical research approach. The types of data used in this study include primary legal materials, secondary legal materials, and tertiary legal materials. Data for this research were obtained through literature review of legal materials, typically derived from laws, books, and other literature sources, as well through interviews with Notary Zulfanovriyendi, SH,MKN,. The analysis utilized in this research is a qualitative analysis method, involving interpretation of the legal materials under study. The results of this research indicate that the business cooperation agreement formed by the notary provides legal certainty before judges and courts in accordance with the law. The document created by the notary in business cooperation serves as strong evidence in accordance with the provisions of the Civil Code or Kitab Undang-Undang Hukum Perdata (KUHPer). Moreover, in this case, it was found that the notary has fulfilled their role and responsibilities in accordance with Undang-undang (UU) No. 2 Tahun 2014 Perubahan atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris. Additionally, the documentary evidence formed by the notary is recognized by the court based on putusan 47/pdt.G/2020/PN Stb, assisting the judge in making decisions in this case. The research also highlights aspects where the notary plays a crucial role in creating legal certainty for parties involved in business cooperation by providing the sole written evidence for the case, acknowledged by the court.
