Abstract

Setiap perjanjian tunduk pada hukum perikatan, sehingga suatu perjanjian harus dilaksanakan dengan itikad baik sebagaimana diatur dalam Pasal 1338 KUHPer.Dalam masyarakat sering terjadi jual beli yang menimbulkan sengketa hukum, khususnya dalam jual beli tanah, antara lain adanya jual beli tanah milik orang lain, di mana tanah tersebut bukan milik si Penjual. Maka dari itu perlu dilakukan penelitian lebih lanjut terkait peran dan tanggung jawab Pejabat Pembuat Akta Tanah dalam membuat akta jualbeli dilihat dari prinsip kehati-hatian untuk menjamin jual beli tanah bebas dari potensi pembatalan akta yang didasari pembeli beritikad tidak baik dan apa akibat hukum dari pembatalan akta jual beli atas dasar pembeli beritikad tidak baik. Dalam kasus sengketa tanah jual beli dilakukan oleh orang yang tidak berhak dalam Putusan Mahkamah Agung Repubik Indonesia Nomor 2235 K/PDT/2022 yang pada inti maejlis hakim membatalkan jual beli tanah dengan pertimbangan pembeli melaksanakan jual beli dengan itikad tidak baik. Pokok permasalahan yang akan dibahas pada tesis ini adalah 1) Bagaimana Peran Pejabat Pembuat Akta Tanah Terkait Dengan Penerbitan Akta Jual Beli Hak Atas Tanah Untuk Mengantisipasi Pembatalan Akta Jual Beli Yang Didasari Pembeli Beritikad Tidak Baik?; Bagaimana Akibat Hukum Terhadap Putusan Pengadilan Yang Menyatakan Pembeli Beritikad Tidak Baik Terhadap Akta Jual Beli Tanah?Penelitian ini menggunakan jenis penelitian normatif empiris, bersumber dari data sekunder yang didukung dengan data primer, menggunakan teknik perolehan data studi kepustakaan dan studi lapangan dengan penekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus, yang kemudian diolah menggunakan metode analisis data kualitatif. Dalam penelitian ini analisis Penulis fokus membahas mengenai itikad tidak baik pembeli yang dapat membatalkan akta jual beli. / Every agreement is subject to the law of engagement, so an agreement must be implemented in good faith as regulated in Article 1338 of the Civil Code. In society, buying and selling often occurs which gives rise to legal disputes, especially in buying and selling land, including buying and selling land belonging to other people, in where the land does not belong to the Seller. Therefore, it is necessary to carry out further research regarding the role and responsibilities of Land Deed Making Officials in making sale and purchase deeds based on the precautionary principle to ensure that land sales and purchases are free from potential cancellation of the deed based on the buyer's bad intentions and what are the legal consequences of canceling the deed buying and selling on the basis that the buyer has bad intentions. In the case of a land dispute, the sale and purchase was carried out by someone who had no rights in the Decision of the Supreme Court of the Republic of Indonesia Number 2235 K/PDT/2022, which in essence the judge's decision canceled the land sale and purchase on the basis that the buyer carried out the sale and purchase in bad faith. The main issues that will be discussed in this thesis are 1) What is the role of land deed drafting officials in relation to the issuance of sale and purchase deeds of land rights to anticipate cancellation of sale and purchase deeds based on the buyer's bad intentions?; What are the legal consequences of a court decision stating that the buyer has bad intentions regarding the land sale and purchase deed? This research uses a type of empirical normative research, sourced from secondary data supported by primary data, using data acquisition techniques from literature studies and field studies with a legislative approach. conceptual approach, and case approach, which are then processed using qualitative data analysis methods. In this research, the author's analysis focuses on discussing the buyer's bad faith which can cancel the sale and purchase deed.
