Abstract

Akta jaminan fidusia merupakan akta otentik yang dibuat di hadapan notaris untuk pembebanan benda dengan jaminan fidusia. Pada prakteknya akta jaminan fidusia dibuat dengan akta notaris, namun perusahaan pembiayaan sering menggunakan surat kuasa membebankan fidusia (Selanjutnya disebut: SKMF) yang dibuat secara bawah tangan dan ditandatangani secara elektronik dalam pembebanan jaminan fidusia. Salah satu hal yang menyebabkan hal ini terjadi perihal biaya yang dikeluarkan oleh debitur/lessee jauh lebih murah dengan menggunakan SKMF. Dalam Undang-Undang Jaminan Fidusia (Selanjutnya disebut: UUJF) tidak ada ketentuan khusus yang mengatur mengenai penggunaan SKMF tersebut menimbulkan permasalahan mengenai keabsahan akta jaminan fidusia dan sertifikat fidusia yang telah terbit. Rumusan masalah pada penelitian untuk mengetahui bagaimana peran notaris dalam pembuatan akta fidusia yang didasari pada SKMF yang dibuat dibawah tangan pada perusahaan pembiayaan? Bagaimana kepastian hukum akta fidusia berdasarkan pada SKMF yang dibuat dibawah tangan dan ditandatangani secara elektronik pada perusahaan pembiayaan? Penelitian ini menggunakan penelitian hukum normatif dengan pendekatan Undang-Undang, pendekatan konseptual dan pendekatan terhadap asas-asas hukum. Berdasarkan pada hasil penelitian ini penulis menarik kesimpulan bahwa peran notaris dalam pembuatan akta fidusia yang dibuat dibawah tangan dan ditandatangani secara elektronik adalah sah sepanjang notaris memanggil kembali para pihak, membacakan kembali isi akta tersebut tentunya isi akta fidusia tersebut diakui oleh para pihak. Akta fidusia akan menjadi tidak sah apabila notaris dalam pembuatan akta fidusia hanya berdasarkan pada SKMF saja tanpa adanya proses pemanggilan para pihak, tidak membacakan isi akta fidusia tersebut, maka akta fidusia akan berubah kedudukannya dari akta otentik yang memiliki pembuktian sempurna di pengadilan akan berubah menjadi akta dibawah tangan apabila dikemudian hari terjadi wanprestasi. Saran penulis adalah notaris dalam membuat akta fidusia meminta SKMF yang dibuat dibawah tangan untuk di legalisasi, perusahaan pembiayaan lebih memperhatikan cara pengikatan jaminan sudah sesuai dengan Undang-Undang agar sifat eksekutorial pada sertifikat fidusia dapat dilaksanakan dengan baik jika jaminan akan eksekusi dalam hal debitur/lessee cidera janji. / A fiduciary guarantee deed is an authentic deed made before a notary to encumber objects with fiduciary guarantees. In practice, a fiduciary guarantee deed is made using a notarial deed, but finance companies often use a power of attorney to charge a fiduciary (hereinafter referred to as: SKMF) which is made privately and signed electronically in charging fiduciary guarantees. One of the things that causes this to happen is that the costs incurred by the debtor/lessee are much cheaper by using SKMF. In the Fiduciary Guarantee Law (hereinafter referred to as: UUJF) there are no specific provisions governing the use of SKMF, which raises problems regarding the validity of fiduciary guarantee deeds and fiduciary certificates that have been issued. The research problem formulation is to find out what the role of a notary is in making fiduciary deeds based on SKMF which are made privately in finance companies? What is the legal certainty of a fiduciary deed based on an SKMF made privately and signed electronically at a finance company? This research uses normative legal research with a legal approach, a conceptual approach and an approach to legal principles. Based on the results of this research, the author draws the conclusion that the role of a notary in making a fiduciary deed that is made privately and signed electronically is valid as long as the notary calls back the parties, reads the contents of the deed again, of course the contents of the fiduciary deed are recognized by the parties. The fiduciary deed will become invalid if the notary, in making the fiduciary deed, is only based on the SKMF without any process of summoning the parties, does not read the contents of the fiduciary deed, then the fiduciary deed will change its position from an authentic deed that has perfect proof in court to become a deed. under your control if a default occurs in the future. The author's suggestion is that when making a fiduciary deed, the notary asks for the SKMF made privately to be legalized, the finance company pays more attention to how the guarantee is tied in accordance with the law so that the executorial nature of the fiduciary certificate can be implemented properly if the guarantee will be executed in the case of the debtor/lessee. breach of contract.
