Abstract

Sistem royalti di Indonesia masih belum memadai untuk memberdayakan musisi dan pencipta lagu, terutama mereka yang sudah tua dan tidak lagi produktif secara finansial. Keberadaan Lembaga Manajemen Kolektif (LMK) dan Lembaga Manajemen Kolektif Nasional (LMKN) ini disinyalir merugikan para pekerja kreatif karena proses penarikan royalti yang tumpang tindih. Fakta yang terjadi bahwa meskipun Peraturan Pemerintah Nomor 56 Tahun 2021 tentang Pengelolaan Royalti Hak Cipta Lagu dan/atau Musik (PP 56/2021) memungkinkan LMKN untuk menarik royalti dari pencipta lagu non-anggota LMK, distribusi royalti hanya diberikan kepada anggota LMK sesuai dengan laporan data lagu di Sistem Informasi Lagu dan/atau Musik (SILM). Namun masih terdapat keraguan dari kalangan pencipta lagu untuk mendaftar sebagai anggota LMK. Adapun permasalahan dari penelitian ini yakni bagaimana implementasi LMK dalam mendistribusikan royalti kepada Pencipta Lagu serta bagaimana upaya LMK untuk mendorong Pencipta Lagu mendaftarkan diri menjadi anggota LMK. Penelitian ini bertujuan untuk memecahkan persoalan hukum mengenai implementasi LMK dalam mendistribusikan royalti kepada Pencipta Lagu serta melakukan penemuan ide hukum agar LMK dapat mendorong Pencipta Lagu untuk mendaftarkan diri menjadi anggota LMK. Pada penelitian ini penulis menggunakan jenis penelitian normatif empiris, dengan menggabungkan penggunaan data sekunder dengan data primer yang penulis dapatkan dari hasil wawancara langsung atau observasi. Hasil penelitian ini adalah implementasi pendistribusian royalti oleh LMK mengalami kendala, terutama dalam tata kelola yang kurang baik, seperti ketidakjelasan jumlah royalti bagi anggota LMK. Hal ini menimbulkan ketidakpercayaan dari para pencipta lagu terhadap LMK. Selain itu, LMKN belum berhasil menyelesaikan SILM, meskipun Pusat Data Lagu dan/atau Musik (PDLM) sebagai database sudah dibuat oleh Direktorat Jenderal Kekayaan Intelektual. PDLM sendiri masih belum optimal karena LMK belum melengkapi data anggotanya, dan penetapan tarif PNBP sebesar Rp 400.000,- menjadi penghambat perkembangannya. LMK perlu melakukan langkah-langkah seperti memperbaiki transparansi dalam pengelolaan royalti, termasuk melengkapi data pencipta lagu pada PDLM untuk memungkinkan penarikan dan pendistribusian royalti secara digital. Sosialisasi, komunikasi, dan kerjasama dengan stakeholder serta kolaborasi dengan instansi penegak hukum dan kementerian terkait juga diperlukan. Pencipta lagu, di sisi lain, perlu menyadari tanggung jawab dan hak atas karyanya, serta saling mengawasi dan mengawal kinerja LMK. / The royalty system in Indonesia is still inadequate to empower musicians and songwriters, especially those who are old and no longer financially productive. The existence of Collective Management Organization (CMO) and National Collective Management Organization (NCMO) is allegedly detrimental to creative workers because of the overlapping royalty collection process. The fact is that even though PP 56/2021 allows NCMO to collect royalties from non-CMO member songwriters, royalty distribution is only given to CMO members according to the song data report in Song and Music Information System (SILM). However, there is still hesitation among songwriters to register as CMO members. The problems of this research are how to implement CMO in distributing royalties to songwriters and how CMO attempts to encourage songwriters to register as CMO members. This research aims to solve legal problems regarding the implementation of CMO in distributing royalties to Songwriters and to find legal ideas so that CMO can encourage Songwriters to register as CMO members. In this research, the author used a type of empirical normative research, combining the use of secondary data with primary data that the author obtained from direct interviews or observations. The results of this research are that the implementation of royalty distribution by CMO is experiencing problems, especially poor governance, such as unclear amounts of royalties for CMO members. This created distrust among songwriters towards CMO. Apart from that, NCMO has not succeeded in completing SILM, even though PDLM (a music and song information system and data center) as a database has been created by he Directorate General of Intellectual Property Right (DJKI). PDLM itself is still not optimal because CMO has not completed its member data, and setting a PNBP rate of IDR 400,000 is an obstacle to its development. CMO needs to take steps such as improving transparency in royalty management, including completing songwriter data on PDLM to enable digital withdrawal and distribution of royalties. Socialization, communication and cooperation with stakeholders as well as collaboration with law enforcement agencies and relevant ministries are also needed. Song creators, on the other hand, need to be aware of their responsibilities and rights for their work, as well as mutually monitor and supervise CMO's performance.
